MINUTES
REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on March 19, 2024. The meeting was called to order by the Mayor Bill Schickel and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Latham, Lee. Absent: Adams.

Adopt Agenda: Motion, Jaszewski; 2nd, Latham that the agenda be adopted. AYES: All (Motion carried.)

Administrator Burnett presented the Monthly Activity Report.

Prior to adopting the Consent Agenda Item #8 was removed to be acted upon separately.

Consent Agenda: Regular Minutes of March 5, 2024; Claims dated February 8 and 24, 2024 in the amount of $1,478,128.32; Prime & Wine – Class C Retail, Catering, Outdoor Service; Target – Class E Retail; North Iowa Events Center – Class C Retail & Outdoor Service (excludes speedway); Danny’s BBQ – Special Class C Retail; Malik #1, #2, #3 – Pending Final Inspections; Tobacco – Legacy Golf Course Malik #1, #2 and #3; Resolution No. 24-52, levying assements for charges on certain properties and the certification of same to the County Treasurer for collection with property taxes within the City of Mason City, Iowa; Resolution No. 24-53, adopting the Revised Personnel Policy Manual for the City of Mason City, Iowa; Resolution No. 24-54, approving publication of notice of hearing upon a consolidated application for Federal Transit Administration Assistance Grant for Non-Urbanized Areas and State Operating Assistance Funds for Transportation and authorizing the submission of the application, setting time and place of public hearing; prescribing form of notice to be given and directing clerk to cause publication of said notice; Resolution No. 24-56, accepting Special Warranty Deed from AP of Mason City LLC for property located in Outlot A of Autumn Park Subdivision; Resolution No. 24-57, authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “2024 Street Panel and Curb Replacement Program Project No. 24-1005”; Resolution No. 24-58, amending Resolution No 24-32, authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “Willow Creek Riverwalk Project” to extend the bidding period to March 26, 2024 and delay the public hearing to April 2, 2024 and change the bid security to 10%; Resolution No. 24-59, amending Resolution No 24-51, authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “Mason City Bike Park Bid Package 2” to extend the bidding period to April 9, 2024 and delay the public hearing to April 16, 2024; Resolution No. 24-60, award of contract to WHKS for professional services related to the FY2024-2025 Sanitary Sewer Repairs, was presented. Motion, Jaszewski; 2nd, Masson that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

8. Approving 2023 Downtown West HOME Grant: Motion, Jaszewski; 2nd, Latham that Resolution No. 24-55, approving property owner applications funder the 2023 Downtown West HOME Pilot Program and authorizing bidding of improvements, be adopted. Questions followed regarding how many homes could benefit. AYES:All (Motion carried.)

2024 MC Community Development Housing Needs Assessment: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections. Development Services Director Van Steenhuyse read the prepared comments. There being no further comments the Public Hearing was declared closed. Motion, Latham; 2nd, Masson that Resolution No. 24-61, adopting the 2024 Community Development Housing Needs Assessment be adopted. Discussion followed regarding not applying for the internet/Wi-Fi grant. AYES: All (Motion carried.)

Embargo Changes: Motion, Jaszewski; 2nd, Masson that Ordinance No. 24-4, amending the City Code by repealing Title 9, Chapter 2 “Traffic Administration” Section 12: Weight Limit, Exceptions: Embargo Established Paragraph A and B in its entirety and adopting a new paragraph A and B in lieu thereof be adopted. Clarification was made that there were no objections. AYES: All (Motion carried.)
Speed Restrictions: Motion, Latham; 2nd, Jaszewski that Ordinance No. 24-5, amending the City Code by repealing Title 9, Chapter 4: Speed Regulations, Section 1: Speed Restrictions and adopting a new Section 1 in lieu thereof, be adopted. AYES: All (Motion carried.)

Zoning Amendments: Motion, Latham; 2nd, Lee that the Ordinance amending the City Code Title 12 “Zoning Regulations”: 12-1; 12-2; 12-5; 12-7; 12-13; 12-15; 12-16; 12-20, be received and placed on file for Second Consideration. AYES: All (motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:25 p.m.
