UPDATED: Jared Kropf back on streets 3 weeks into 5 year prison term

UPDATED 8-1: NorthIowaToday.com had originally reported Tuesday night 7-31 that both Kropf brothers had been released from prison. CORRECTION: We have learned that only Jared has been released from prison at this time.

Brandon, the younger of the two brothers, according to court records has not been released at this time. According to records Brandon sent a letter to the courts and motioned the court to reconsider his sentencing on July 26th. That same day Assistant Chief Judge James M. Drew denied the motion for reconsideration. At this time Brandon has not filed an appeal with the courts.

Brandon is currently housed in Iowa Prison’s Medical & Classification Center with a scheduled release date of October 18th, 2014, 2 years 3 months from his intake date according to Vinelink.com.

Just twenty days after being sentenced to serve five years in prison Jared Kropf has been released back to the streets while awaiting an appeal of his sentence.  Court records show Clear Lake bonding agent Jim Finstad posted $10,000 surety for Jared Kropf’s release from prison through Sun Surety Insurance Company on July 30th.

Brandon and Jared Kropf had been sentenced after voluntarily pleading guilty for the assaults against two men which caused one of the victims to be seriously injured requiring intensive care at St. Mary’s in Rochester after allegedly using bats and crowbars on April 3rd, 2011.

Originally both men faced three class “C” felony charges of willful injury causing serious injury, one count against Jared and two counts against Brandon before entering into a plea bargain with the prosecution. As part of the plea deal Senior Judge Paul Riffel approved an application to amend class “C” felony charges of willful injury causing serious injury to lesser class “D” felony charges. The original class “C” felony charges of willful injury causing serious injury originally filed could have carried up to 10 years in prison under Iowa Code.

At sentencing on July 10th Assistant Chief Judge James M. Drew sentenced both men to the maximum of up to five years in prison on one amended class “D” felony charge of willful injury causing bodily injury each. As part of the plea agreement Judge Drew dismissed one of two class “C” felony charges of willful injury causing serious injury against Brandon.

Court records show on July 23rd Jared filed notice of appeals by certified service. By July 30th Jared was released from prison pending his appeal with the Iowa Court of Appeals. At this time no further court dates show his the case.

Court records show last week the Cerro Gordo County District Court has also dismissed two other pending criminal charges of concealing a knife used in a crime and driving while barred habitual offender against Jared. It is unclear rather these charges were also dropped as part of the original plea agreement with the prosecution.

  1. Funny how things come full circle.

    About 15 years ago, at 2:00AM, I caught this Barrientez fellow breaking into my garage with another fellow, a big tall drink of pee pee, I think his name was Jeff Sestino. He and his buddy started to attack me with some 2 foot lengths of chains they had around their waist, but when my wife yelled she was calling the cops they ran. I was lucky, they pair had 20 years on me and I would not have stood a chance. Had I known what was going on when I heard the noise outside, I would not have went outside. Wasn’t expecting these two knuckle-draggers to be breaking into my garage. I didn’t bother the Police, they would not have done anything anyway.

    Later it was this this Barrientez fellow that was with Guy Baker up in Minneapolis when the Baker kid shot and killed a policeman. Barrientez got nothing from that incident. They were heavy into drugs I am guessing.

    Then years later these Kropf kids kick the tar out of him real good. I understand Barrrientez lost an eye. Not sure?

    This Barrientez fellow is just another no good.

    My point, what goes around comes around. Or, live by the sword and die by the sword.

    Oh well.

    1. Watchdog, You left out when Barrientez and Sestina were fighting, so Jay tried to shoot Jeff. And Guy Baker was already serving two life terms, so Guy lied and told the jury Guy did it. The jury fell for it! So Jay, of all people, should know juries can find even the Kropfs not guilty.

  2. The victim is not a stand up guy….but those defending these 2 socialpaths need to really think hard. These 2 brothers are just as bad and if ANY one commits a crime this bad and thinks its justified there is something terribly wrong with them. Knowing right from wrong is learned in the 1st 7 years in life. These 2 socialpaths intented to kill the victim …..all over drugs and sleeping with their woman. These 2 cannot be reformed…look up socialpath and you will inderstand these 2… theirpictures should be right next to the definition!

  3. HELLO to everyone bitching about the judges and county atty etc etc, u r all so blind to the much larger issue at hand. No judge is at fault here. Judges ensure that citizens get a fair trial and they aren’t the ones offering these plea agreements. They don’t benefit at all by putting criminals back on the street. Plea agreements cause the judges MORE WORK actually bcuz they now get to see these criminals back in their courtroom with new charges inevitably.
    The county attorney’s office benefits from these plea agreeements because it saves them from having to do ANY WORK!! They don’t have to prove their case or present the facts at trial. They won’t be embarrassed if they fail at getting a conviction. it has become so common practice in the courts for defendants to take plea agreements, that ourcounty attorney’s office doesn’t really know how to TAKE A CASE TO TRIAL. lol.. I wouldnt be surprised one little bit if his appeal is due to inadequacies of the county attorney. There is a reason they aren’t in a private law practice having to solicit business based on their legal “talent” or record of wins….. wake up ppl

    1. K2thamfcknP, Why don’t you tell Jamaal Leslie that? And tell Bennie Harrington, Shug Williams, Robert Carter, Damian Seats, and Michael Weatherspoon, too. I’m sure it will make their sentences go a lot faster knowing that the lawyers who sent them away for life don’t know how to TAKE A CASE TO TRIAL.

  4. its 4 in the morning, do u know where Jared kropf is…? out and about trying to elude police on northWEST side of town… ditched the bike he was riding just off 12th st, cops followed him with lights on thru alleys and one on foot detained him for questioning… hmmm, eager to hear what there is to do at 4AM in darkened alleys OTHER than the most obvious no good.. this makes it 2-2, that the cops have had run ins with him in the days released back into mason… will it ever stop????

  9. Let’s trash the Constitution with all it’s guarntees! Why allow an appeal, as provided under the Constitution? Why allow Trial by Jury? You folks have tried them already.

    Instead folks, ask youselves, what the appeal based on a technical reason? Was the appeal based on misconduct? Was the appeal based on not being fairly or effectively represented by counsel?

    And last question, if YOU were found guilty of something, should we lock the door and throw away the key without any right of recourse?

  10. It makes me wonder if “who” these people beat up is the reason they are out so early. If the two men they attacked were good upstanding citizens in the community, it might be different. But the two men they attacked have shady pasts also and have had numerous problems with the law.

  13. I got to spend 7 days in jail for going 10 miles over the speed limit and not pulling over for the cops for 4 blocks, judge grupp told me I had to learn my lesson. F**k the county attorney and these crooked judges Im going to start playing Charles Bronson.

  16. How is it you plead guilty to a lesser charge and still have the right to an appeal?

    This should never have happened. Once they plead guilty, they should have started serving there sentance an no appeals.

    Fix the system.

    1. DA can offer anything they want but its the judge that has the final say he can reject the plea deal and give the full sentence.

  17. these two clowns were already all over the air waves yesterday- took like 4-5 cops all in patrol cars then eventually a few on foot to try and catch one of these two who was out joyriding on a dirt/mini bike… didn’t catch why this incident was called in, but 1 cop said thought it was one of those ‘kropft boys’ then yet another was like no, he’s in prison (must’ve been Jared he referring to) and then said it must be the younger one… so long story short- proven fact they cant go longer than 24 hrs without getting into some sort of trouble!!

    1. That was me on the four wheeler and the minibike. The MCPD really needs some help in the investigation department.

  18. Do you all know how to vote? Do you vote, or just complain? Are you doing anything to help or again, just complaining? I know it’s very discouraging to see these people out on the streets so soon but ALL of Iowa’s prisons are WAY over their limits now.
    Did you know that the very first thing they do to you in Iowa prisons, when you are admitted,is to automatically cut whatever sentence in 1/2. YES, it’s exactly what they do. Speak up. Let your government officials, that you voted in, know how you feel about issues.
    When was the last time you communicated with your local council?, your local senator?, or your local representative? Make a difference or quit complaining!!!

  20. i am asking this because I dont know the answer. maybe someone can help. since the brothers filed an appeal on the lower class “D” charges. even after offering a guilty plea. can they now be reserved with all the original class “C” charges? If not, then why can the criminals change their mind and the courts cant??

    1. No it can’t be changed. The bad guys can make numerous appeals on anything. The prosecutor only gets one chance. The bad guys have alot more rights than the good guys when it comes to court issues.

If we didn’t have them the judicial system would be so backed up that the streets would be WAY more full of violent criminals. Didn’t you read the article?? They were bonded out pending appeal. Since you can’t vote out a bondsman, you choose to attack the system? At least be informed before you spout off. Particularly when the information is right in front of you.     1. you are wrong Jill…probably 1% of the population is doing 99% of the crime. what is the population of mason City vs the amount of criminals that have gone before a judge. I dont know that answer. maybe Matt or someone can get that information and report it. the courts wouldnt be as full and backed up if the criminals were in jail and not on the streets repeating crimes. BTW have these two brother ever been in trouble before? please answer this someone. if the answer is yes then I have proven my point.

    2. Jill-The county attorneys plead down EVERY SINGLE case they get. The judges let them out or accept a lower plea bargin, when they should be getting the book thrown at them. My brand of IDIOCRACY is evidentally common sense since I am a citizen who is willing to VOTE OUT the people who cant deal with the problems to begin with. They should have recieved a hell of a lot more than 20 days, and how on earth you get BONDED out of prison is beyond me. Maybe you shouldn’t spout off when you don’t know what you are talking about. We have people beating and killing each other in this town and they are getting a slap on the wrist!!! I am appalled at our judges and district attorney’s, they should hang their heads for this. I for one will be one to be voting out these idiots, I hope you all join me. I am utterly sickened as a parent. The Kropft parents should be ashamed of their children and themselves.
