Mason City man receives deferred judgement

Anthony Alitz, age 21 of Mason City received a deferred judgment on July 5th, 2011 in Cerro Gordo county district court case 02171 FECR019577. According to online court records Anthony Alitz was charged on December 13th, 2010 with 3rd degree sexual abuse, a class c felony. The criminal complaint accuses Anthony Alitz of being an adult and performing a sex act with a minor four or more years younger than him, and the victim being no more than fourteen to fifteen years of age.

During the time Anthony Alitz has been released on bond for the original felony sexual abuse charge, he has twice been arrested for contempt of court for violating a no contact order levied against him by the court. In the first no contact order violation, he was found guilty by the court and received seven day a sentence in jail. The second no contact order violation resulted in a voluntary negotiated guilty plea in which he received fourteen days in jail. He is currently serving the fourteen days in the Cerro Gordo county jail.

As part of the deferred judgment for sexual abuse, Judge James M. Drew imposed a $1000.00 civil penalty and $916.50 in court costs and attorney fees to the public defender’s office. Judge James M. Drew also terminated the no contact order and ordered Alitz to complete probation with the Department of Corrections for 3 years. In accordance with Iowa law, Anthony Alitz must also register as a sex offender for 10 years. Alitz will have 5 days from his release date on July 18th, 2011 for violation of the no contact order, to complete his sex offender registration.
