MINUTES
REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on March 5, 2024. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Adams, Symonds, Latham, Lee. Absent: None.

Adopt Agenda: Motion, Masson; 2nd, Jaszewski that the Agenda, be adopted. AYES: All (Motion carried.)

The Mayor proclaimed Friday, Marach 8, 2024 as Layla Phillips Day in recognition of her victory as Girls State Wrestling Champion.

A PowerPoint presentation was provided by Angie Kolz of WHKS on Phase 4 Inflow and
Infiltration results were provided. Council comments and questions followed the report.

Prior to adopting the Consent Agenda Item #9, #11, #12 and #15 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of February 20, 2024; Claims dated February 8 and 24, 2024 in the amount of $912,844.41; Mulligans -Class C Retail; Hy-Vee #1 – Class E Liquor, C Beer, B Wine; Dollar General #23916 – Class B Retail; Mason City Parks & Rec (Highland Golf Course) -Class C Retail, Outdoor Service; Mason City Parks & Rec (Softball Complex) – Special Class C Retail, Outdoor Service; Pacific Islands Blue Wave – Class C Retail; Appoint Brent Hinson to the Winnebago River Watershed Management Coalition (City Representative); Appoint/hire Meriel Johnson as Recreation Programmer – Aquatics & Activities at Grade J Step 1 ($28.48); Resolution No. 24-40, approving a revised wage schedule with teamsters local 238 (Police Department); Resolution No. 24-42, fixing a date for a public hearing on proposal to enter into a Sewer Revenue Loan and Disbursement Agreement and to borrow money thereunder in a principal amount not to exceed $180,000; Resolution No. 24-45, authorizing notice to bidders, fixing amount of bid security, and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “2024 Pavement Marking Program Project No. 24-1003”; Resolution No. 24-46, award contract to Short Elliott Hendrickson, Inc. of Mason City, Iowa for professional services related to the 43rd Street SW Lift Station and Force Main Project; Resolution No. 24-48, setting a date for a public hearing on Urban Renewal Plan Amendment No. 11 for the Mason City Unified Urban Renewal Area; Resolution No. 24-51, authorizing notice to bidders, fixing amount of bid security and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “Mason City Bike Park Bid Package 2”; Resolution No. 24-50, fixing a date of meeting for public hearing on the receipt and approval of proposals for the disposal and development of certain City-owned Real Property in the Mason City Downtown Reinvestment Urban Renewal Area”; Resolution No. 24-51 authorizing notice to bidders, fixing amount of bid security and ordering clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “Mason City Bike Park Bid Package 2”, was presented. Motion, Jaszewski; 2nd, Latham that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

9. Designating Madison School as City Park: Motion, Masson; 2nd, Jaszewski that Resolution No. 24-41, designating the Madison School area as a City Park under the purview of the Mason City Park and Recreation Board, be adopted. Clarification was made regarding why this was necessary. AYES: All (Motion carried.)

11. Order Hearing – Sewer Revenue Loan & Disbursement Agreement ($1,525,000): Motion, Lee; 2nd, Latham that Resolution No. 24-43, to fix a date for a public hearing on proposal to enter into a Sewer Revenue Loan and Disbursement Agreement and to borrow money thereunder in a principal amount not to exceed $1,525,000, be adopted. Clarification was made regarding the amortization schedule and the combined Lift Station and Nutrient Reduction costs (the $31 million would include the lift station). AYES: All (Motion carried.)

12. Truth in Taxation Hearing: Motion, Jaszewski; 2nd, Lee that Resolution No. 24-44, setting a date for a public hearing on the “Truth in Taxation” preliminary hearing for the Mason City, Iowa FY25 Budget, be adopted. Discussion followed regarding the State “Truth in Taxation” notice. AYES: All (Motion carried.)

15. Development Agreement – Seefried Properties: Motion, Masson; 2nd, Jaszewski that Resolution No. 24-47, approving and authorizing execution of a Development Agreement by and between the City of Mason City and Seefried Development Management, Inc. for a future street (extension of South Washington Avenue), be adopted. Discussion followed regarding how many jobs and when construction would begin. AYES: All (Motion carried.)

Zoning Amendments: The Public Hearing was held as per published notice. Mayor Pro tem Adams asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Latham that Ordinance amending the City Code Title 12 “Zoning Regulations”: 12-1; 12-2; 12-5; 12-7; 12-13; 12-15; 12-16; 12-20, be received and placed on file for First Consideration. AYES: All (Motion carried.)

Embargo Changes: Motion, Masson; 2nd, Latham that the Ordinance amending the City Code by repealing Title 9, Chapter 2 “Traffic Administration” Section 12: Weight Limit, Exceptions: Embargo Established Paragraph A and B in its entirety and adopting a new paragraph A and B in lieu thereof be received and placed on file for Second Consideration. AYES: All (Motion carried.)

Speed Restrictions: Motion, Latham; 2nd, Masson that the Ordinance amending the City Code by repealing Title 9, Chapter 4: Speed Regulations, Section 1: Speed Restrictions and adopting a new Section 1 in lieu thereof, be received and placed on file for Second Consideration. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:32 p.m.
