Clear Lake man says he’s not guilty of domestic assault

CLEAR LAKE – A man taken to jail by Clear Lake police after a domestic incident says he’s not guilty.

Michael Lee Magnan, age 36 of Clear Lake, was arrested by police on April 13 after officers were called to investigate a domestic incident. Magnan was taken to the county jail on a charge of serious domestic assault. He was later released on his own recognizance.

Magnan later entered a not-guilty plea, and a jury trial was schedule for August 9. A judge denied the victim’s request to lift a no-contact order with Magnan.

Back in 2001, an altercation occurred between Magnan and a group of five friends coming home after a night of drinking at local bars and parties. The altercation ended up with one of the group of friends sustaining a head injury; it was reported that Magnan struck the man with a club. Magnan ran from the scene but turned himself in to the Clear Lake police the next morning. He was charged with willful injury, a class “D” felony. A jury found Magnan guilty as charged and he was sent to prison. In later court proceedings, however, the felony charge was reduced to an aggravated misdemeanor charge of assault use / display of a weapon.
