MASON CITY – Mason City police were called to Wal-Mart this weekend after a drunken fracas involving three Mason City men.
Mason City police received a radio report at about 9:50 PM Sunday evening to the Wal-Mart store located at 4151 4th Street SW and arrested three adult male subjects for serious or aggravated public intoxication. According to Mason City police, they have had “257 calls to the Wal-Mart area, since January 1, 2013. Not all may be affiliated to Wal-Mart just occurred on or near their property.”
A bystander told NIT that the three men were “loud” and “causing trouble.”
Arrested and charged were: Timothy Dean Smith (3rd or subsequent public intoxication arrest), age 24; John Lee Smith, age 25; and Kyle Allen Smith (3rd or subsequent public intoxication arrest), age 26.
Timothy Dean Smith was also charged with violating a no contact order filed against him to protect a 20 year old Mason City female. Smith is also awaiting a February 10, 2014 court date on an assault charge brought by the Cerro Gordo County Sheriff’s Office. Smith plead guilty on September 30th to public intoxication.
