Open burning ban in Cerro Gordo County now effective

MASON CITY – The State Fire Marshal’s office has issued an open burning ban in Cerro Gordo County effective at 9:30 a.m. this morning. This ban is in effect until further notice.

ON JULY 17, 2012, THE OFFICE OF THE STATE FIRE MARSHAL RECEIVED A REQUEST PURSUANT TO IOWA CODE 100.40(1) (1995) FROM BOB PLATTS, REPRESENTING EACH FIRE DEPARTMENT HAVING ALL OR PART OF THEIR FIRE DISTRICT WITHIN CERRO GORDO COUNTY, THAT THE STATE FIRE MARSHAL PROHIBIT OPEN BURNING IN CERRO GORDO COUNTY.

UPON INVESTIGATION THE FIRE MARSHAL FINDS THAT CONDITIONS IN CERRO GORDO COUNTY ARE SUCH THAT OPEN BURNING CONSTITUTES A DANGER TO LIFE OR PROPERTY. IT IS THEREFORE ORDERED THAT NO PERSON SHALL ENGAGE IN OPEN BURNING IN CERRO GORDO COUNTY, EFFECTIVE JULY 17, 2012 AT 9:30 A.M.. EXCEPT AS SPECIFICALLY PERMITTED BY IOWA CODE 100.40(3) UNTIL SUCH TIME AS BOB PLATTS, REPRESENTING EACH FIRE DEPARTMENT
HAVING ALL OR PART OF THEIR FIRE DISTRICT WITHIN CERRO GORDO COUNTY, NOTIFIES THE STATE FIRE MARSHAL THAT SUCH CONDITIONS DANGEROUS TO LIFE OR PROPERTY NO LONGER EXISTS.

NOTICE IS HEREBY GIVEN THAT PURSUANT TO IOWA CODE 100.4(2) ANY VIOLATION OF THIS
PROCLAMATION ORDER IS A SIMPLE MISDEMEANOR.

state law code 100.40 says ban on open burning !not firepits or certin burn barrels [read the law ] fire pits are not open burns. sorry joe.

Fire pits IN town should be permanantly banned. Our fire chief agrees. “Can’t burn leaves, can’t burn trash, so WHY allow these fire pits?” If you want a camp fire, go camping!

Sorry Joe. Fire pits are legal in the city. 🙂 And they SHOULD BE!

Wasn’t the DNR the ones who tried to burn during the last one we had? If I remember right the fire got away from them and burned a field.

Thanks everyone for the replies. Guess I won’t be enjoying a fire in the backyard anytime in the near future. Needless to say, who would want to with this dreaded heat we have been having!! LOL!! Hate to say it, but I am kinda looking forward to Fall!!

Yes, the ban applies to fire pits in your back yard.

Yes, I believe this does apply to fire pits.

Does this mean people can’t use their firepits in their backyards? Just curious.
