Deferred judgment handed down in bribery case

19-year-old Brittlyn Marie Minert was the driver of a vehicle pulled over by members of the Cerro Gordo County Sheriff’s Department on Hwy 122 in Clear Lake in the evening hours of September 4th, 2011. Deputies on scene suspected Minert of operation under the influence. Deputies alleged Minert had offered a bribe not to be arrested for 1st offence OWI.

As a result deputies arrested Minert and transported her to Cerro Gordo County Jail on one Class “D” felony charge of bribery and a serious misdemeanor charge of 1st offence OWI.

On Monday, May 14th, at a scheduled sentencing hearing presiding District Court Judge Rustin T. Davenport handed down a deferred judgment on the bribery charge. As part of the deferred judgment Minert must complete 2 years of probation thru the Iowa Department of Corrections.

Minert had also entered a voluntary negotiated guilty plea to the OWI charge on May 4th. Judge Davenport sentenced her to serve four days in jail or in lieu of the sentence Minert may complete a second chances program. Minert must also pay a $1250 fine, $437.50 in surcharges, and $370 in court costs.

A deferred judgment refers to a postponed or delayed judgment. In a deferred judgment, the court gives a defendant an opportunity to complete a probationary period before sentencing and prior to any entry of conviction. If the defendant successfully completes probation at the conclusion of the probationary period the court will review the defendant’s file and may dismiss the charges against him/her.

If the defendant does not follow all of the terms and conditions of probation the court may enter the conviction and sentence the defendant accordingly. Normally, if a person pleads guilty or is found guilty of new criminal charges the case proceeds to sentencing. When a deferred judgment is obtained the case is frozen between the guilty plea and sentencing.

    There are two or three “Minert” Families this area . Just an FYI.

  4. Skylee et al; it’s public information what happened. If folks wish to comment about it, they have every right to do so. If anything, telling them to mind their own business only encourages further query.

    Is it a shame what she did? Of course. Should the rest of us ignore it? I don’t see that happening. Does it lend credence to an attitude of being above the law because of her family? Sure does. Just ask Leona Helmsly.

    Bribery went out with the old Chicago Democratic Machine. In these times, officers want to keep their jobs, so why would they even risk it with inappropriate behavior?

      Regardless of the deferred judgement their is no way in hell your sister will pee clean and not get more alcohol charges for 2 years.

  5. Didn’t Scott get 15 years in prison for forgery, unauthorized use of credit cards, and conspiracy. He gets out of prison and now has access to everybody’s credit information that applies for credit at his shop. You think any of his customers know this?

  6. I always love it when people comment but don’t put who they are and hide behind made up names.
    Personally I don’t know this girl nor am I aware of any legal issues that her family as gotten out of.
    I strongly suggest that Dynasty Buster if he has proof of what he speaks he should do something about it.
    for starters use his or her real name.

I’m a family member! Brittlyn, is a young girl making mistakes in life. She will learn and mature from this. We all have made mistakes in our youth…

  8. I think she looks like a typical 19 year old. She tried something and it didn’t work out like she had probably been told it would. I hope that she gets clear of this.
