Newark city spokesman Mark Di Ionno said that the city—home to 1,198 families who are part of the program— is “in the process of passing an ordinance to ban New York from sending us SOTA clients.” New York’s state senate also opened an investigation into New York City’s program to ship the homeless to cities in upstate New York. Not really! Have you been to a college game and sat on the first row by the players/coaches? I have. It is incredible the way refs get treated sometimes. The swearing and the name calling happens a lot. Some refs take it and some will not.

Does the North Iowa Event Center pay ASCAP/BMI fees for concerts during fair? They by law need too. If singers sing songs that are not written by them, Cerro Gordo County could be sued for copy write infringement. I noticed no door stickers saying they do. Many singers are singing other peoples songs, this is a big deal.

ASCAP has always been very aggressive in perusing venues for licensing fees. Under the premise that they are collecting for their writer members they often file large lawsuits against small venues and businesses to force them to pay up. This recently happened on Long Island NY Fairgrounds. Sometimes these tactics scare venue owners away from presenting Live music altogether. ASCAP’s aggressive attitude towards collecting licensing fees from venues and fair facilities was illustrated by a recently filed suit against the Girl Scouts. ASCAP claimed that because they sang “Campfire” songs that were written by ASCAP writers they were entitled to collect licensing fees from them. Fortunately for the Girl Scouts they dropped their action against them because of intense negative publicity.
But, if done fairly, this should not really be an issue! Having an organization collect and distribute monies for the writers of the music that is being performed is not a bad thing. ASCAP has a formula to determine how much a venue’s fee would be. This formula takes into account the amount of seats are in a venue, among other factors. But, one thing that needs to be taken into consideration that is often overlooked by ASCAP. Most venues that present Live music don’t sell every seat and many times they lose money. These venues are the breeding ground for the artists of the future. Without the local music venues, musicians would not have a place to learn their craft. Venues are 100% responsible for any songs played to the public from their venue. Huge fines can bee distributed to the venue.Schools usually pay for a blanket policy for all events, this does not include schools were a large venue is run as a organized entity.-ASCAP/BMI
Nope, it is the venue. Nowhere in an artist contract does ascap or bmi or secan fees mentioned, it falls to the venue or promoter.
It is the music venues responsibility to make sure any music sung from their property is covered by the 3 music licensing firms. If a dance number has music it is still subject to this rule. If Julie Smith sings in a talent competition, it is subject to this rule. Call ASCAP or BMI and they will confirm.
