NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF “2022-23 SANITARY SEWER REPAIRS”, IN AND FOR THE CITY OF MASON CITY, IOWA, AND THE TAKING OF BIDS FOR SAID IMPROVEMENTS
Sealed proposals, subject to the conditions contained herein, will be received by the City Clerk of the City of Mason City, Iowa, at the City Clerk’s office in City Hall at Mason City, Iowa, until 10:00 o’clock a.m. on the 13th day of September, 2022 for:
Construction of “2022-23 Sanitary Sewer Repairs”, as hereinafter described in general and as described in detail in the plans and specifications now on file in the office of the City Clerk, Mason City, Iowa.
Proposals received will be opened, read aloud, tabulated, and referred to the City Council for consideration at 7:00 p.m. on the 20th day of September, 2022. Bids will be acted upon at such time or at such later time as may then be fixed. Prior thereto, at said time specified above, in the Mason City Room at the Mason City Public Library, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto.
The extent of the work involved is the furnishing of labor and new materials for sanitary sewer point repairs, sanitary manhole repairs, and Cured-In-Place-Pipe rehabilitation in the north central and other areas, in accordance with the contract documents.
The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 5% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 5% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 5% of bid amount.
The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.
The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the Requirements of Iowa Code, Section 26.8.
Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.
Bidders shall not be permitted to withdraw their bids for a period of thirty (30) days after the same are opened.
By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa and to Iowa domestic labor.
In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.
Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.
Pursuant to City Ordinance No. 94-3, legally known as Title I, Chapter 10, of the Municipal code, general bidders shall include Form DBE 1. Prospective bidders’ or contractors’ attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractors’ attention is also directed to the fact that the Mason City Human Rights Commission may notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties. Determination of certification of compliance with these specifications shall be conducted by the Mason City Human Rights Director, following receipt of bids from prospective bidders or contractors.
The established DBE goal for this project is 0% of the total project amount. The goals are subject to waiver by the commission.
The right is reserved, as the interest of the City may require, to reject all bids, any unresponsive bid and to waive technicalities in bids received.
The Contractor shall commence work after the Notice to Proceed is issued and shall be completed on or before October 4th 2023.
Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the Owner.
The Contractor will be paid each month ninetyfive (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.
The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the Owner and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the Owner from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of two (2) year(s) after completion and acceptance by the Owner.
Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the Owner referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.
Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $100.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited.

Donations can be dropped off anytime between 8 a.m. and 11 a.m Monday thru Friday except on holidays.
Individuals who bring their fruits and vegetable donations are asked to park by the garage entrance on the south end of the Hawkeye Harvest Food Bank building.
A volunteer will meet them and take their donated produce at that time.
Hawkeye Harvest Food Bank is located at 122 South Adams, one block west of the downtown arena.

“Iowans believe in protecting our freedom and ability to make our own health care decisions, including access to abortion. But once again, Governor Kim Reynolds is working to take that freedom away, and is teaming up with a hate group to do it.
“This morning, Gov. Reynolds announced that she has filed a motion to challenge the injunction on the Fetal Heartbeat Bill. The law would have barred most abortions after six weeks, often times before a person even knows they are pregnant. Back in 2019, an Iowa judge rightfully ruled that the law could not be enforced because it violates the Iowa Constitution.
“Now, Gov. Reynolds is trying to reinstate her radical Fetal Heartbeat Bill with the help of Alliance Defending Freedom, a hate group as identified by the Southern Poverty Law Center. For a crime that would get a Russian a fine or 2 weeks in detention, she receives 9 years. What would you say if the FBI arrested a Russian hockey player with a roach in his car and gave him 9 years in prison?

REGULAR MEETING
OF THE CITY COUNCIL
The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on August 2, 2022. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Adams, Symonds. Absent: Thoma, Lee.
Adopt Agenda: Motion, Masson; 2nd, Jaszewski that the agenda be adopted. AYES: All (Motion carried.)
The Mayor proclaimed Wednesday, October 19, 2022 as “Mason City Chamber of Commerce Day” and presented a Resolution of appreciation for Team River City RAGBRAI.
Prior to adopting the Consent Agenda Item #5 and #9 were removed to be acted upon separately.
Consent Agenda: Regular and Worksession Minutes of July 19, 2022; Claims dated July 21 and 28, 2022 in the amount of $2,050,869.32; Hy-Vee Gas #2 – Class C Beer Permit; State Street Deli – Class B Beer, Class B Native Wine; Appoint Paul Adams , Colleen Niedermayer and Melissa Fabian to the Mason City’s representatives to the Joint Planning Committee for the North Iowa Corridor Joint Comprehensive Plan; Resolution No. 22-166, authorizing approval of a supplemental maintenance agreement to a 28E Agreement between the City of Mason City and the IDOT for mowing and litter removal along IA 122 & US 65 as defined in the agreement;
Resolution No. 22-167, authorizing approval of a supplemental maintenance agreement to a 28E Agreement between the City of Mason city and the IDOT for maintenance and repair of primary roads in municipalities, Resolution No. 22-168, accepting work and ordering payment for construction of the “Winnebago River Low Head Dam Mitigation – Winnebago Dam No. 1”. Motion, Symonds; 2nd Jaszewski that all items in the Consent Agenda be approved and Resolutions adopted. AYES: ALL (Motion carried.)
5.June 2022/Year-End Financial Report: Motion, Adams; 2nd, Jaszewski that the Report be approved. Discussion followed regarding the importance of Local Option Sales and Service Tax, accounting practices and changes, contingency fund, etc. AYES: All (Motion carried.)
9. Award Contract & Approve Contract & Bond Sanitary Sewer CCTV Phase 4”: Motion, Adams, 2nd, Symonds that Resolution No. 22-169, award of contract to Visu-Sewer, Inc. of Pewaukee, Wisconsin and approving contract and bond for the Sanitary Sewer CCTV Phase 4 Project, be adopted. Questions followed regarding what part of town they would be working in and how they dealt with all the buried cable. AYES: All (Motion carried.)
10.Sale of Property – 1422 North Hampshire Place: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Masson; 2nd, Jaszewski that Resolution No. 22-170, , authorizing conveyance of public property located at 1422 North Hampshire Place to adjacent property owners, be adopted. AYES: All (Motion carried.)
11. 2022 G.O. Bonding – Direct Sale: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Adams; 2nd, Masson that Resolution No. 22-171, directing sale of $4,545,000* (subject to adjustment per terms of offering) General Obligation Bonds, Series 2, be adopted. Comments followed regarding the City’s bond rating, the interest rate, etc. AYES: All (Motion carried.)
12. Ordinance Maintenance of Public Property: Motion, Adams; 2nd, Symonds that Ordinance No. 22-10, amending Title 5, Chapter 1, and Title 4, Chapter 1, Section 3 of the City Code of the City of Mason City, Iowa, pertaining to the maintenance of public property by abutting property owners, be adopted. AYES: All (Motion carried.)
Adjourn: The Mayor adjourned the meeting at 7:39 p.m.
