AN ORDINANCE AMENDING TITLE 5, CHAPTER 1, AND TILE 4, CHAPTER 1, SECTION 3 OF THE CITY CODE OF THE CITY OF MASON CITY, IOWA, PERTAINING TO THE MAINTENANCE OF PUBLIC PROPERTY BY ABUTTING PROPERTY OWNERS
WHEREAS, the City Council has determined it is necessary to amend Title 5, Chapter 1 and Title 4, Chapter 1, Section 3 of the Code of Ordinances of the City of Mason City, Iowa (“City Code”) to explicitly address abutting property owners’ responsibilities to maintain public property outside of lot and property lines as provided for in Iowa Code Section 364.12(2)(c).
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MASON CITY, IOWA
Section 1: That the City Code of the City of Mason City, Iowa, should be and the same is hereby amended by adding Article H to Title 5, Chapter 1 of the City Code as follows:
“ARTICLE H. MAINTENANCE OF PUBLIC WAYS BY ABUTTING PROPERTY OWNERS
5-1H-1 OWNER RESPONSIBILITY:
As provided for in Iowa Code Section 364.12, an abutting property owner shall maintain all property outside the lot and property lines and inside the curb lines upon public streets and shall keep such area in a safe condition, free from nuisances, obstructions, and hazards. In the absence of a curb, such property shall extend from the property line to that portion of the public street used or improved for vehicular purposes. The abutting property owner shall not be required to remove diseased trees or dead wood on the publicly owned property or right-of-way. Maintenance includes, but is not limited to, timely mowing, trimming trees and shrubs, and picking up litter and debris. The abutting property owner may be liable for damages caused by failure to maintain the publicly owned property or right-of-way.
5-1H-2 VIOLATION; ENFORCEMENT:
Failure to comply with the provisions of this Article shall constitute a public nuisance pursuant to applicable provisions of Title 4, Chapter 1 of this Code and shall be enforced accordingly.
Section 2: That the City Code of the City of Mason City, Iowa, should be and the same is hereby amended by adding Subsection E to Title 4, Chapter 1, Section 4-1-3 of the City Code as follows:
“E. The maintenance of public property outside lot and property lines by the abutting property owner as set out in in Section 5-1H-1 of this Code.”
Section 3: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 4: If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of this Ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 5: This ordinance shall be in full force and effect upon its final passage, approval and publication as required by law.

COUNCIL WORKSESSION
The City Council of the City of Mason City, Iowa, met in Worksession pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library at 5:30 P.M., on July 19, 2022. The meeting was called to order by the Mayor and on roll being called, there were present, Mayor Schickel in the Chair and the following Council Members: Masson, Jaszewski, Lee, Symonds, Adams. Absent: Thoma (arrived via Zoom at 5:46 p.m.).
Kentucky/Illinois Grade Separation Feasibility Study Presentation:
Administrator Burnett provided background and introduced Fouad Daoud with WHKS who reviewed the Study Team (Aaron Burnett, Mark Rahm, Fouad Daoud, Jake Shaw and Scott Sweet) and provided a presentation, noting as a result of public input a 3rd Option was presented. The areas covered were as follows:
Purpose and Need: Grade separation was identified as a priority; Reduce carbon dioxide emissions; Reduce congestion & improve traffic flow; Provide a safe connection for vehicular and non-motorized traffic; Open additional access to residential housing; Emergency access improvement.
Advantages: Improved traffic flow; Reduced congestion; Reduced vehicle emissions; Improved safety for vehicular and non-motorized traffic; Improved emergency response access.
Disadvantages: Visual impact to surrounding area; Possible increased noise levels; Increased traffic through residential areas; Acquisition of property.
Overpass Alternative:
Advantages: Minimal disruption to RR operations; Less impact on future RR expansion; Favored by RR; No lift stations for storm or sanitary; Less right of way acquisition; Additional access to developable land.
Disadvantages: Visual impact to surrounding area; Possible increased noise levels.
Underpass Alternative:
Advantages: Less visual impact to surrounding area; Possible reduced noise levels.
Disadvantages: Greater disruption to RR operations; Greater impact on future RR expansion; Lift stations for storm and sanitary; More right of way acquisition.
Information was presented regarding South Kentucky Underpass, South Illinois Overpass – Option 1, South Illinois Overpass – Option 2 and South Illinois Overpass – Option 3. For each of the options ownership, acquisition, construction schedule, and costs were discussed. Daoud stated they had met three times with the Railroad (not in favor of an underpass at Kentucky). He stated per the Railroad, there were 5 trains per day, however with the CP being acquired by another company the number of trains between Chicago and St. Louis would triple and would be a 2 to 3 train increase in Mason City per day. He also provided the statistics they obtained from the cameras they had set up and talked about the impacts with the biggest differences being bridge length, construction costs and impact to the residents.
Funding Sources were as follows:
City: Local Option Sales Tax and General Obligation Bonds.
State: Iowa Clean Air Attainment Program (ICAAP), Traffic Safety Improvement Program (TSIP), Iowa Transportation Alternatives Program (TAP), State Recreational Trail Program and Revitalize Iowa’s Sound Economy (RISE).
Federal: Railroad Crossing Elimination Grant Program, INFRA Grant (Nationally Significant Multimodal Freight & Highways Projects), Safe Streets & Roads for All.
Railroad
The Mayor asked about neighborhood integrity with Daoud stating if they choose to go east, the only thing acquired would be land.
Burnett emphasized there was a window of opportunity for significant Federal funding at this time and there was always the “do nothing” option, but the train traffic would continue.
Daoud pointed out the State funds were available every year, but the Federal funds would expire in 5 years and all of those pots of money were new and believed the Railroad Separation Fund might have 1,000 applicants, but next year it might be 3,000 to 4,000.
Jaszewski asked how long the overpass would last with Daoud stating 70 years with good maintenance.
Masson asked if they had any idea how much the cost to the City would be with Daoud stating they didn’t know how much, but with the 12th Street Overpass, over 90% was paid for by the Federal government and with 19th Street it was 60%.
5:46 p.m. Thoma entered the Council Worksession via Zoom.
Masson mentioned he would like to have more data over the course of the year with Daoud stating the Railroad does not track their stops and starts.
Masson asked if the switching could take 45 minutes with Daoud concurring.
Lee stated he wanted to know more about the property acquisition process and whether it would be market value or eminent domain with Daoud advising with respect to the 12th Street Overpass they had all been receptive to being purchased, so the City bought their homes.
Lee mentioned they weren’t the same type of homes with Daoud agreeing.
Lee also pointed out that the purchase of more properties would take greater time, so while Option 3 was $17 million it might be quicker in the long run with Burnett stating obviously if it was a drawn out process it could cause a lot of issues with funding and that was the reason Option 3 was brought forward. He also stressed it opened up more development opportunities and while the cost was higher, future development could be rolled into it.
Adams questioned the timeline for making a decision with Burnett advising Option 3 came about as a result of the public meeting and there would continue to be community conversation, however the constraint was the grant funds, emphasizing it would be beneficial to move forward quickly because without federal funding this would not move forward.
Discussion followed regarding the grant deadline.
Adams stated the Kentucky proposal was the only one where the Railroad would own the bridge and asked what the implications were with Daoud stressing he would not recommend that and explained why.
Adams asked if all parts of the project eligible for funding included acquisition with Daoud concurring.
Symonds asked if new roads were included with Option 3 with Daoud stating they were and 2 roundabouts and extending 19th Street.
Symonds asked if property owners would be assessed for the new roads with Burnett stating this would be an arterial road, so they would not be assess.
Symonds questioned how Option 3 would help with development with Burnett stating there was increased accessibility and the section off 19th was not limited, so pushing it out would allow for more development.
Jaszewski asked if the City received the funds this year would they have to be spent this year with Daoud stating he was not sure how long the City could retain the funds without spending it.
Discussion followed regarding ways to fund the project.
Masson asked if the study included an assessment on which option would have the least impact to property owners with Daoud stating they had not looked at that, but it would probably be Option 3.
Masson asked what street was available if the Railroad was switching with the Mayor stating it would be Federal.
Lee questioned if the Council went with the most expensive option and received grants was the City locked into that Option meaning could they return the money with Burnett concurring, advising there would obviously be some costs incurred, but they could return the grant.
Lee emphasized the Council needed to continue to pursue this, noting it has been talked about for 20 years and in his eyes, it was either Illinois or Option 3.
Adams referenced Option 3 and public safety, stating it didn’t appear it would save time with Daoud stating it would just guarantee they would not be stopped by a train and Burnett stressing the City could not enforce the stoppage, nor could the Police write a ticket to the Railroad and it was not unusual to have a stoppage that lingered much longer than the acceptable time frame, noting the Railroad could stop for whatever and whenever they wanted.
Jas added the City has experience with that and referenced Quiet Zones, emphasizing as far as he was concerned the underpass was off the table.
The Mayor adjourned the meeting at 6:12 p.m.

It’s not science, it’s politics. I’ve been listening to this bullshit for 50 years. In the 60s all the oil would be gone, in 10 years! In the 70s we were going to have another ice age, in 10 years! In the 80s it was Acid Rain that was going to destroy all the crops in 10 years! In the 90s, it was the Ozone Layer that would be destroyed in 10 years! In the 2000s, it was the Glaciers that were going to melt, in 10 years! In the 2010s, the East and West coast would be underwater from rising sea levels, in 10 years!

Today’s announcement includes more HIMARS advanced rocket systems and other weapons that Ukrainians are using so effectively on the battlefield to defend their country. This drawdown, combined with an additional $95 million announced separately today under DoD’s Ukraine Security Assistance Initiative, will bring total U.S. military assistance to Ukraine to approximately $8.2 billion since the beginning of this Administration.

DNR Director issues statement about incident at Maquoketa Caves State Park

I, as well as the DNR staff, am devastated for the families impacted by the tragic incident at Maquoketa Caves State Park. Our long standing tradition of enjoying Iowa’s natural wonders was shaken today, but the legacy for the millions of families that recreate at Iowa State Parks will continue. This heartbreaking incident hits home for the DNR family; not only as people who are passionate about getting folks outside, but as people who regularly camp with our families at these same parks.
We appreciate the collaborative work between local law enforcement, the Iowa Department of Public Safety and the DNR State Parks staff and conservation officers on this investigation.

NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF “2022 MULTI-BRIDGE REPAIR PROJECT”, IN AND FOR THE CITY OF MASON CITY, IOWA, AND THE TAKING OF BIDS FOR SAID IMPROVEMENTS
Sealed proposals, subject to the conditions contained herein, will be received by the City Clerk of the City of Mason City, Iowa, at the City Clerk’s office in City Hall, 10 First Street NW, Mason City, Iowa, until 11:00 o’clock a.m. CDT on the 9th day of August, 2022 for:
Construction of “2022 Multi-Bridge Repair Project”, as hereinafter described in general and as described in detail in the plans and specifications now on file in the office of the City Clerk, Mason City, Iowa.
Bids received after the deadline for submission of bids as stated herein shall not be considered and shall be returned to the late bidder unopened.
Proposals received will be opened, read aloud, tabulated, and referred to the City Council for consideration at a meeting beginning at 7:00 p.m. on the 16th day of August, 2022 in the Mason City Room, Mason City Public Library, 225 2nd Street SE, Mason City, Iowa. Bids will be acted upon at such time or at such later time as may then be fixed. Prior thereto, at said time specified above, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto.
The extent of the work involved is the furnishing of labor and new materials required for repairs that include: replace handrails on bridge on Pierce Ave. NW over Willow Creek, replace expansion joint material and reset abutment bearing on bridge on 19th St. SW over UP Railroad, approach repair and joint material replacement on bridge on 12th St. NW over UP Railroad, and other misc. repairs.
The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 10% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 10% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 10% of bid amount.
The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.
The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the requirements of Iowa Code section 26.8.
Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.
Bidders shall not be permitted to withdraw their bids for a period of forty-five (45) days after the same are opened.
The City of Mason City, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for the award.
Prospective bidders’ or contractor’s attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractor’s attention is also directed to the fact that the Mason City Human Rights Commission will notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties.
The established DBE goal for this project is 0% of the total amount bid.
By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa.
In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.
Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.
The Contractor shall commence work after the Notice to Proceed is issued and work shall be completed on or before December 2, 2022.
Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the City.
The Contractor will be paid each month ninetyfive (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.
The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the City and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of two (2) years after completion and acceptance by the City.
Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the City referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.
Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $50.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited.
The City does hereby reserve the right to reject any or all bids, to waive informalities, and to enter into such contract, or contracts, as it shall deem to be in the best interest of the City.

Not only do they lie about how far you can drive an electric car, but they lie about the cost of setting up a charging station in the house. Then add batteries only good for 4 years and good luck replacing them. Also add how poisonous these batteries are and hazardous to the environment and our health.
As time goes on we are finding out more and more how the lied to us about electric cars. Not only are they too expensive for most people the upkeep is out of sight. Very expensive tires that only last 1/3rd of the time due to weight, there is battery replacement at around 4 years at 20K before labor and the lack of mileage plus the time to recharge, not to mention your electric cost going through the roof.
We just need as many alternatives as possible, so the oil barons can’t mess with us anymore, like they’re doing now. These high oil prices are happening because rich oilmen are throwing a tantrum.

The principles of the Artemis Accords, grounded in the Outer Space Treaty of 1967, advance the NASA-led Artemis program, which will put the first woman and first person of color on the Moon and prepare the way for a human mission to Mars. Artemis relies on a broad and diverse international coalition, working together to achieve an historic and ambitious vision for human space exploration.
As Accords signatories, state actors advance responsible behavior in outer space, including through the registration of space objects, deconfliction of activities, release of scientific data, and provision of emergency assistance. Together, signatories will reduce uncertainty and increase the safety of space operations to facilitate the sustainable use of space to the benefit of all humankind.
The Kingdom of Saudi Arabia is the 21st nation to sign the Accords, joining Australia, Bahrain, Brazil, Canada, Colombia, France, Israel, Italy, Japan, the Republic of Korea, Luxembourg, Mexico, New Zealand, Poland, Romania, Singapore, Ukraine, the United Arab Emirates, the United Kingdom, and the United States. AN ORDINANCE AMENDING TITLE 5, CHAPTER 1, AND TILE 4, CHAPTER 1, SECTION 3 OF THE CITY CODE OF THE CITY OF MASON CITY, IOWA, PERTAINING TO THE MAINTENANCE OF PUBLIC PROPERTY BY ABUTTING PROPERTY OWNERS
WHEREAS, the City Council has determined it is necessary to amend Title 5, Chapter 1 and Title 4, Chapter 1, Section 3 of the Code of Ordinances of the City of Mason City, Iowa (“City Code”) to explicitly address abutting property owners’ responsibilities to maintain public property outside of lot and property lines as provided for in Iowa Code Section 364.12(2)(c).
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MASON CITY, IOWA
Section 1: That the City Code of the City of Mason City, Iowa, should be and the same is hereby amended by adding Article H to Title 5, Chapter 1 of the City Code as follows:
“ARTICLE H. MAINTENANCE OF PUBLIC WAYS BY ABUTTING PROPERTY OWNERS
5-1H-1 OWNER RESPONSIBILITY:
As provided for in Iowa Code Section 364.12, an abutting property owner shall maintain all property outside the lot and property lines and inside the curb lines upon public streets and shall keep such area in a safe condition, free from nuisances, obstructions, and hazards. In the absence of a curb, such property shall extend from the property line to that portion of the public street used or improved for vehicular purposes. The abutting property owner shall not be required to remove diseased trees or dead wood on the publicly owned property or right-of-way. Maintenance includes, but is not limited to, timely mowing, trimming trees and shrubs, and picking up litter and debris. The abutting property owner may be liable for damages caused by failure to maintain the publicly owned property or right-of-way.
5-1H-2 VIOLATION; ENFORCEMENT:
Failure to comply with the provisions of this Article shall constitute a public nuisance pursuant to applicable provisions of Title 4, Chapter 1 of this Code and shall be enforced accordingly.
Section 2: That the City Code of the City of Mason City, Iowa, should be and the same is hereby amended by adding Subsection E to Title 4, Chapter 1, Section 4-1-3 of the City Code as follows:
“E. The maintenance of public property outside lot and property lines by the abutting property owner as set out in in Section 5-1H-1 of this Code.”
Section 3: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 4: If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of this Ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 5: This ordinance shall be in full force and effect upon its final passage, approval and publication as required by law.

COUNCIL WORKSESSION
The City Council of the City of Mason City, Iowa, met in Worksession pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library at 5:30 P.M., on July 19, 2022. The meeting was called to order by the Mayor and on roll being called, there were present, Mayor Schickel in the Chair and the following Council Members: Masson, Jaszewski, Lee, Symonds, Adams. Absent: Thoma (arrived via Zoom at 5:46 p.m.).
Kentucky/Illinois Grade Separation Feasibility Study Presentation:
Administrator Burnett provided background and introduced Fouad Daoud with WHKS who reviewed the Study Team (Aaron Burnett, Mark Rahm, Fouad Daoud, Jake Shaw and Scott Sweet) and provided a presentation, noting as a result of public input a 3rd Option was presented. The areas covered were as follows:
Purpose and Need: Grade separation was identified as a priority; Reduce carbon dioxide emissions; Reduce congestion & improve traffic flow; Provide a safe connection for vehicular and non-motorized traffic; Open additional access to residential housing; Emergency access improvement.
Report Components: Grade Separation; Existing Conditions; Constraint; Design Criteria; Alternatives; Construction; Impacts; Cost; Funding.
Advantages/Disadvantages of a Grade Separation;
Advantages: Improved traffic flow; Reduced congestion; Reduced vehicle emissions; Improved safety for vehicular and non-motorized traffic; Improved emergency response access.
Disadvantages: Visual impact to surrounding area; Possible increased noise levels; Increased traffic through residential areas; Acquisition of property.
Overpass Alternative:
Advantages: Minimal disruption to RR operations; Less impact on future RR expansion; Favored by RR; No lift stations for storm or sanitary; Less right of way acquisition; Additional access to developable land.
Disadvantages: Visual impact to surrounding area; Possible increased noise levels.
Underpass Alternative:
Advantages: Less visual impact to surrounding area; Possible reduced noise levels.

Information was presented regarding South Kentucky Underpass, South Illinois Overpass – Option 1, South Illinois Overpass – Option 2 and South Illinois Overpass – Option 3. For each of the options ownership, acquisition, construction schedule, and costs were discussed. Daoud stated they had met three times with the Railroad (not in favor of an underpass at Kentucky). He stated per the Railroad, there were 5 trains per day, however with the CP being acquired by another company the number of trains between Chicago and St. Louis would triple and would be a 2 to 3 train increase in Mason City per day. He also provided the statistics they obtained from the cameras they had set up and talked about the impacts with the biggest differences being bridge length, construction costs and impact to the residents.
Funding Sources were as follows:
City: Local Option Sales Tax and General Obligation Bonds.
State: Iowa Clean Air Attainment Program (ICAAP), Traffic Safety Improvement Program (TSIP), Iowa Transportation Alternatives Program (TAP), State Recreational Trail Program and Revitalize Iowa’s Sound Economy (RISE).
Federal: Railroad Crossing Elimination Grant Program, INFRA Grant (Nationally Significant Multimodal Freight & Highways Projects), Safe Streets & Roads for All.
Railroad
The Mayor asked about neighborhood integrity with Daoud stating if they choose to go east, the only thing acquired would be land.
Burnett emphasized there was a window of opportunity for significant Federal funding at this time and there was always the “do nothing” option, but the train traffic would continue.
Daoud pointed out the State funds were available every year, but the Federal funds would expire in 5 years and all of those pots of money were new and believed the Railroad Separation Fund might have 1,000 applicants, but next year it might be 3,000 to 4,000.
Jaszewski asked how long the overpass would last with Daoud stating 70 years with good maintenance.
Masson asked if they had any idea how much the cost to the City would be with Daoud stating they didn’t know how much, but with the 12th Street Overpass, over 90% was paid for by the Federal government and with 19th Street it was 60%.
5:46 p.m. Thoma entered the Council Worksession via Zoom.
Masson mentioned he would like to have more data over the course of the year with Daoud stating the Railroad does not track their stops and starts.
Masson asked if the switching could take 45 minutes with Daoud concurring.
Lee stated he wanted to know more about the property acquisition process and whether it would be market value or eminent domain with Daoud advising with respect to the 12th Street Overpass they had all been receptive to being purchased, so the City bought their homes.
Lee mentioned they weren’t the same type of homes with Daoud agreeing.
Lee also pointed out that the purchase of more properties would take greater time, so while Option 3 was $17 million it might be quicker in the long run with Burnett stating obviously if it was a drawn out process it could cause a lot of issues with funding and that was the reason Option 3 was brought forward. He also stressed it opened up more development opportunities and while the cost was higher, future development could be rolled into it.
Adams questioned the timeline for making a decision with Burnett advising Option 3 came about as a result of the public meeting and there would continue to be community conversation, however the constraint was the grant funds, emphasizing it would be beneficial to move forward quickly because without federal funding this would not move forward.
Discussion followed regarding the grant deadline.
Adams stated the Kentucky proposal was the only one where the Railroad would own the bridge and asked what the implications were with Daoud stressing he would not recommend that and explained why.
Adams asked if all parts of the project eligible for funding included acquisition with Daoud concurring.
Symonds asked if new roads were included with Option 3 with Daoud stating they were and 2 roundabouts and extending 19th Street.
Symonds asked if property owners would be assessed for the new roads with Burnett stating this would be an arterial road, so they would not be assess.
Symonds questioned how Option 3 would help with development with Burnett stating there was increased accessibility and the section off 19th was not limited, so pushing it out would allow for more development.
Jaszewski asked if the City received the funds this year would they have to be spent this year with Daoud stating he was not sure how long the City could retain the funds without spending it.
Discussion followed regarding ways to fund the project.
Masson asked if the study included an assessment on which option would have the least impact to property owners with Daoud stating they had not looked at that, but it would probably be Option 3.
Masson asked what street was available if the Railroad was switching with the Mayor stating it would be Federal.
Lee questioned if the Council went with the most expensive option and received grants was the City locked into that Option meaning could they return the money with Burnett concurring, advising there would obviously be some costs incurred, but they could return the grant.
Lee emphasized the Council needed to continue to pursue this, noting it has been talked about for 20 years and in his eyes, it was either Illinois or Option 3.
Adams referenced Option 3 and public safety, stating it didn’t appear it would save time with Daoud stating it would just guarantee they would not be stopped by a train and Burnett stressing the City could not enforce the stoppage, nor could the Police write a ticket to the Railroad and it was not unusual to have a stoppage that lingered much longer than the acceptable time frame, noting the Railroad could stop for whatever and whenever they wanted.
Jas added the City has experience with that and referenced Quiet Zones, emphasizing as far as he was concerned the underpass was off the table.
The Mayor adjourned the meeting at 6:12 p.m.

DNR Director issues statement about incident at Maquoketa Caves State Park
Statement from Kayla Lyon, Iowa DNR Director:
I, as well as the DNR staff, am devastated for the families impacted by the tragic incident at Maquoketa Caves State Park. Our long standing tradition of enjoying Iowa’s natural wonders was shaken today, but the legacy for the millions of families that recreate at Iowa State Parks will continue. This heartbreaking incident hits home for the DNR family; not only as people who are passionate about getting folks outside, but as people who regularly camp with our families at these same parks.
We appreciate the collaborative work between local law enforcement, the Iowa Department of Public Safety and the DNR State Parks staff and conservation officers on this investigation.
STATEMENT: Gov. Reynolds’ thoughts and prayers aren’t enough
Des Moines, Iowa — Progress Iowa Executive Director Matt Sinovic issued the following statement in response to the deadly shooting at Iowa’s Maquoketa Caves early this morning:
“No one should have to fear their loved ones being taken too soon because of gun violence. Our hearts are broken for the victims of today’s shooting at the Maquoketa Caves State Park Campground.
“Once again in the wake of tragic gun violence, Iowa Governor Kim Reynolds is only offering empty words and prayers instead of action and policy change. Tragedies like those outside East High in Des Moines, outside a church in Ames and now at a campground in Maquoketa have forced Iowa families to grieve loved ones far too soon. Yet, Gov. Reynolds hasn’t flinched, as if these lives don’t matter.
“What will it take for Governor Reynolds to take some meaningful action? How many have to die before she comes to the table with real solutions? It’s time to pass common-sense gun safety laws to prevent further tragedy.”

Construction of “2022 Multi-Bridge Repair Project”, as hereinafter described in general and as described in detail in the plans and specifications now on file in the office of the City Clerk, Mason City, Iowa.
Bids received after the deadline for submission of bids as stated herein shall not be considered and shall be returned to the late bidder unopened.
Proposals received will be opened, read aloud, tabulated, and referred to the City Council for consideration at a meeting beginning at 7:00 p.m. on the 16th day of August, 2022 in the Mason City Room, Mason City Public Library, 225 2nd Street SE, Mason City, Iowa. Bids will be acted upon at such time or at such later time as may then be fixed. Prior thereto, at said time specified above, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto.
The extent of the work involved is the furnishing of labor and new materials required for repairs that include: replace handrails on bridge on Pierce Ave. NW over Willow Creek, replace expansion joint material and reset abutment bearing on bridge on 19th St. SW over UP Railroad, approach repair and joint material replacement on bridge on 12th St. NW over UP Railroad, and other misc. repairs.
The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 10% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 10% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 10% of bid amount.
The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.
The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the requirements of Iowa Code section 26.8.
Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.
Bidders shall not be permitted to withdraw their bids for a period of forty-five (45) days after the same are opened.
The City of Mason City, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for the award.
Prospective bidders’ or contractor’s attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractor’s attention is also directed to the fact that the Mason City Human Rights Commission will notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties.
The established DBE goal for this project is 0% of the total amount bid.
By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa.
In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.
Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.
The Contractor shall commence work after the Notice to Proceed is issued and work shall be completed on or before December 2, 2022.
Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the City.
The Contractor will be paid each month ninetyfive (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.
The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the City and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the City from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of two (2) years after completion and acceptance by the City.
Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the City referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.
Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $50.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited.

The United States welcomes Saudi Arabi’s signing of the Artemis Accords on July 14, affirming its commitment to safe, sustainable, and responsible space exploration. Mohammed Saud al-Tamimi, CEO of the Saudi Space Commission, signed the Accords on behalf of the Kingdom of Saudi Arabia and was joined during a virtual ceremony by Her Royal Highness Princess Reema bint Bandar bin Sultan bin Abdulaziz Al Saud, Ambassador to the United States, Abdullah bin Amer al-Swaha, Saudi Minister of Communications and Information Technology, Bill Nelson, Administrator of the National Aeronautics and Space Administration, Martina Strong, Chargé d’Affaires for the United States Mission to Saudi Arabia, and Principal Deputy Assistant Secretary Jennifer R. Littlejohn from the Department of State Bureau of Oceans and International Environmental and Scientific Affairs.
The principles of the Artemis Accords, grounded in the Outer Space Treaty of 1967, advance the NASA-led Artemis program, which will put the first woman and first person of color on the Moon and prepare the way for a human mission to Mars. Artemis relies on a broad and diverse international coalition, working together to achieve an historic and ambitious vision for human space exploration.
As Accords signatories, state actors advance responsible behavior in outer space, including through the registration of space objects, deconfliction of activities, release of scientific data, and provision of emergency assistance. Together, signatories will reduce uncertainty and increase the safety of space operations to facilitate the sustainable use of space to the benefit of all humankind.
The Kingdom of Saudi Arabia is the 21st nation to sign the Accords, joining Australia, Bahrain, Brazil, Canada, Colombia, France, Israel, Italy, Japan, the Republic of Korea, Luxembourg, Mexico, New Zealand, Poland, Romania, Singapore, Ukraine, the United Arab Emirates, the United Kingdom, and the United States. Saudi Arabia is the seventh nation to sign the Artemis Accords since January 2022 and the fourth Middle Eastern nation to join.
