MASON CITY – Police put a stop to a potentially life-threatening situation when youths were throwing “large rocks” from a bridge onto passing cars below.
On September 12, at around 11:38 PM, an officer was driving a police car in the 400 block of 13th Street NE when someone threw “large rock”s from the old railroad train trestle, which struck the squad car. The officer pulled over and noticed fresh damage in multiple places to the squad car from the rocks. Around this time, another motorist reported that someone had thrown a large rock from the same bridge and cracked the windshield on his vehicle.
Police immediately searched the area and were able to flush three juveniles out from the brush where they were detained near 9th and Elm Drive. The three juveniles caught are: Kyle Movick (Age 14); Tucker Duckert (Age 14); and Leon Walker (Age 10).
All three juveniles were charged with third degree criminal mischief, an aggravated misdemeanor. The three juveniles were booked that night and released to their parents. The criminal charges were referred to juvenile court services.
Damage to the two vehicles is estimated to be approximately $500-$750.
Earlier this year, an Ohio schoolteacher was critically injured when teens threw a rock from an overpass. The rock went through the windshield and smashed her face, causing critical injuries.

Give these boys and their parents the Singapore ass whooping they need. Give them about 4-5 slashes with that whip and they will think twice before doing it again but give their parents a few more for being stupid.
In my opinion, the parents need it worse than the kids. This kind of stuff wouldn’t happen if parents actually cared about their kids enough to discipline them. Discipline = love.
wow! really? where the heck was the parents to these kids? why were they out so late? total BS! yep dhs is really doing their job aren’t they? i agree with alot of people. they basicly commit attempted murder and get that charge when kids pull bark off a tree and get a felony? WTF? if some one can figure out how to change the law and the justice system i will stand behind you 110% some one also needs to call dhs on these so called parents of the these 3 kids. they obviously dont want the kids.
And the expert said that the tree should remain since it may continue to live for a long time…it isn’t dead…So they seem unsure of what to do and where to go with it. I know the MCPD doesn’t make the laws, I get that….but they do have choices on how they proceed with investigations and such…no different than them choosing to give a warning instead of a speeding ticket. I’m a Paralegal, so the unjust system is no surprise to me but that doesn’t mean I don’t have a right to be mad

But according to the school and JCS the MCPD presses the charges….they just cooperate….Kind of funny how the Officer told me he had to check with the school district to see how they wanted to proceed the night he came to my house to talk to the boys about the tree incident. We are still not even close to a resolution since they say the tree is dead….but we were told by an expert that the tree had issues before the bark was peeled off….that is why it came off in chunks and so easily.
If the tree was on school property, then the school is the “victim.” Therefore the reason they were contacted, so the school chose to press charges.
Really….charges are figured according to amount of damage
and thats why the difference in Felony and misdemeanor.
If you really are that pissed off maybe teach your kids to respect

IN grade school at WASHINGTON ELEMENTARY in Mason City, I remember as a child watching an awareness movie about the dangers of vandalism. One of the scenes in the movie involved child vandals throwing a large stone off a freeway bridge, smashing the windshield of a passing car below, resulting in the accident and death of the driver. I’ll never forget how graphic and scary that film was. Maybe Anita needs to dig through the closets and play that movie again for children.

Wow, I remember watching the same video at Roosevelt Elementary in the late 1980’s. Scary stuff for young kids but I never did throw anything off an overpass!

Your right, it is basic math, but the school system has got the highest priced tree remover in town. I’m sure if Miner was to check around the cost would be a lot lower. By the looks of the tree, it’s not going to last much longer anyway. Hell, I’ll cut it down for free, and even go out and buy a replacement.
Cops can trump up charges as they see fit. I’m sure if certain individuals were caught doing something similar to this then the cops would have likely charged them with assault on a police officer or what have you. Even though it was nighttime, I’m sure those kids could see the vehicles they were throwing the rocks on and could have easily seen the cop car….And as far as the basic math comment; I’m sure they know the legalities. But the idea of it is crazy. And where did you come up with…
Where did you come up with $5000? That compared to $750 is a HUGE difference and one would be an idiot to dispute that amount of damage….but when you compare the ACTUAL amount of $1100 (give or take) to $750….well then its a difference of a couple hundred dollars that I am sure a few (cheaper) estimates could be used to make up for the difference.
A charge comes into place from hat a person did and estimated costs to repair or replace. The code is divided up into charges based on real costs not what could have happened.

How is what the boys DID to the tree worse then what the kids DID…
I am appalled that this potentially life threatening circumstance was only a misdemeanor, bit kids pulling bark off a tree is a felony? OMG the justice system is messed up!! And who let’s their 10 year old out that late? Wow, wow, wow. At such a loss for words.
11:30 on a Friday night and children 14 and younger were out running the streets? Wow, that is certainly some great parenting skills. They’ve obviously been taught the value of human life.

Very good point. These kids get misdemeanor charges for potentially life threatening actions, while two other kids get felony charges for a tree. What the hell is wrong in this town?
