Winnebago County sex offender sent back to prison

FOREST CITY – On Tuesday, January 8th, convicted sex offender James Edward Destival was sentenced back to prison for burglary and violating sex offender exclusion zones in Winnebago County.

Destival was convicted of 709.12 Indecent Contact with a Child age 0-13 in Winnebago County in 2001. Originally he received a suspended sentence for the incident with the child but was sentenced to serve 2 years in prison in 2002 after violating probation a 2nd time.

In May of 2012 Destival was charged in Winnebago County with one class D felony count of Sex Offender Area or Activity Violation – 2nd or Subsequent Offense. Seneca Insurance Company posted a $5,000 bond for Destival’s release the same day he was arrested.

While Destival was out on bond in September 2012 Forest City Police again charged him with one class D felony count of Sex Offender Area or Activity Violation – 2nd or Subsequent Offense and one class D felony count of 3rd Degree Burglary.

The May 2012 charge was dismissed on application by the Winnebago County Attorney’s Office, and Destival pled guilty to the August sex offender exclusion zone and the burglary as part of a plea agreement.

On Tuesday, January 8th, presiding District Court Judge Rustin T. Davenport sentenced Destival to serve up to 5 years in prison concurrently for each of the felony charges he previously pled guilty to. Judge Davenport also ordered DNA sampling of Destival.

Winnebago County Sheriff’s Department transferred Destival to Oakdale Prison on the 9th. The Iowa Department of Corrections has already set a release date of December 18th, 2014, less than 2 years from his commitment to prison.
