Menard’s being sued for falling snow

Snow falling from a rooftop at Menard’s at 540 village Green Drive in Mason City and injuring a man has prompted a lawsuit.

According to a lawsuit filed on December 13th, 2010, Dennis Nussbaum visited the Menard’s store in Mason City on December 19, 2008, to purchase carpeting.

At around 1:00 PM that day, Nussbaum drove to the designated pick-up location at the Menard’s store to load up his carpeting. Menard’s employees helped Nussbaum load the carpeting into his vehicle.

While standing next to his vehicle in the loading area, Nussbaum was struck by a large accumulation of snow that fell from a roof over-hanging the loading area, the lawsuit states.

The lawsuit alleges that Menard’s was negligent for failing to remove this dangerous accumulation of snow from the roof in an area where it knew customers would be and for directing customers to be in an area where a dangerous condition existed.

Nussbaum claims in the lawsuit that he has incurred medical expenses; lost wages; endured pain, suffering and mental anguish; and suffered a loss of function of the mind and body.

The lawsuit is asking for fair and reasonable compensation for the damages allegedly sustained by Nussbaum, together with interest and the cost of the lawsuit.|
