REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on October 17, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Lee, Symonds, Adams. Absent: None.

Adopt Agenda: Motion, Masson; 2nd, Symonds that the agenda be adopted. AYES: All (Motion carried.)

The Mayor proclaimed the month of October as “Disabilities Awareness Month”.

Administrator Burnett presented the Monthly Activity Report. Council comments and questions followed the report.

Prior to adopting the Consent Agenda Item #10 and #11 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of October 3, 2023; Claims dated September 21 and 28, 2023, in the amount of $1,766,567.04; Three Bells Books – Special Class C; Appoint/hire Taran Eastman as Arborist Heavy Equipment Operator; Resolution No. 23-111, establishing a new fund 543-Police Task Force Equipment within the City’s Chart of Accounts; Resolution No. 23-212, approving the official 2022-2023 fiscal year Street Finance Report for the City of Mason City, Iowa; Resolution No. 23-213, approving the purchase of replacement basketball hoops, poles and backboards for the Monroe Park Basketball Complex from Decker Sporting Goods of Mason City, Iowa, was presented. Motion, Jaszewski; 2nd, Masson that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

10. Execution Economic Development Grant Agreement: Motion, Jaszewski; 2nd, Adams that Resolution No. 23-214, approving and authorizing execution of an Economic Development Grant Agreement with Habitat for Humanity of North Central Iowa for the renovation of three existing rental houses into single-family homes, be adopted. Discussion followed regarding funding/financing. AYES: All (Motion carried.)

11. Accept and Participate in Settlement – 503 S Federal Avenue: Motion, Jaszewski; 2nd, Symonds that Resolution No. 23-215, approving and authorizing execution of a Settlement Release Agreement between the City and Vance Jorgensen dba Vance Jorgensen Law Firm and Highway 18, LLC and the Cincinnati Insurance Company related to a partial collapse of a building located at 503 S. federal avenue that occurred on June 29, 2021, be adopted. Comments followed regarding the settlement. AYES: All (Motion carried.)

Vacate Storm Sewer Easement adjacent to the Southport Shopping Center abutting S. Federal Avenue: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with the reply being there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Lee; 2nd, Adams that Resolution No. 23-216, authorizing vacation of a portion of a storm sewer easement adjacent to the Southport Shopping Center and abutting South Federal Avenue, be adopted. AYES: All (Motion carried.)

Addendum to Real Estate Purchase Agreement: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with the reply being there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Masson that Resolution No. 23-217, approving and authorizing execution of an Addendum to the Real Estate Purchase Agreement with North Iowa Housing Development Corporation pertaining to property locally known as 1526 South Taft Avenue, 316 5th Street Northwest, 220 and 220 ½ 12th Street Southeast, be adopted. AYES: All (Motion carried.)

Building Regulations – Plumbing/ Mechanical Inspector Qualifications: Motion, Lee; 2nd, Masson that the Ordinance be received and placed on file for second consideration. Motion, Jaszewski; 2nd, Lee to waive second consideration. AYES: All (Motion carried.) Motion, Adams; 2nd, Lee that Ordinance No. 23-13, amending the City Code, by repealing Title 10 “Building Regulations”, Chapter 2: “Building Codes”, Article C: “Plumbing Code”, Section 4: “Plumbing/Mechanical Inspector, Paragraph C “Qualifications” and adopting a new Paragraph C in lieu thereof, be adopted.

Adjourn: The Mayor adjourned the meeting at 7:30 p.m.
