Most of you have never had to deal with the State bureaucracy down in Des Moines. In this respect, I have been unfortunate. Unless one is a multi-millionaire who can afford these $1,000 an hour attorneys to represent you, the system is rigged against you.

The bureaucrats have figured out if you bring an issue to their attention without an attorney representing you, the bureaucrat will explain either his agency is the wrong agency for your issue or your case does not have any merit.

I appealed a property tax assessment. This was an odd piece located a ways away from the Cedar River, too small to build a house on. A realtor who is good at appraisals agreed with me the parcel was overvalued. I appealed to the State. I lost, I represented myself. It was explained I lost because I had no comparable, a comparison of a similar piece that recently sold. Problem is, a comparable in this instance does not exist. If the State agreed with me, it would have required work on their part.

I recently filed a complaint on a violation of Iowa’s Open Meetings and Open Records Laws. The violators did eventually admit they violated the law. The bureaucrat in charge ruled the violation was a harmless oversight so therefore no punishment and no work once again for the bureaucrat.

I believe we need to fight back on the system. . The next time you receive a citation for a violation of the law, explain it was a harmless oversight if no one was injured and demand no fine. Cite Case # 21PC0061 of the Iowa Public Information Board as precedence for no fine. Insist you are within your rights under case law.
