King’s effort to end “Birthright Citizenship” for illegals advanced by President Trump

WASHINGTON, D.C. – Congressman Steve King, a member of the House Judiciary Committee, releases the following statement in the wake of news reports that President Trump intends to restore the plain meaning of the 14th Amendment by ending the mistaken practice of granting American citizenship at birth to the children of illegal aliens. King is the recognized leader in Congress on this effort, and is the lead author of HR 140, a bill ending “birthright citizenship’ that he has introduced in each Congress since 2011.

“I am delighted to learn that President Trump intends to end automatic citizenship at birth for the children of illegal aliens whose parents have no ties, and owe no allegiance, to the United States,” said King. “Granting ‘birthright citizenship’ is a historical mistake which attempts to erase the phrase ‘and subject to the jurisdiction thereof’ out of the 14th Amendment in defiance of what the framers of that amendment were attempting to achieve. Ending ‘birthright citizenship’ for illegal aliens will decimate the disgusting ‘birth tourism’ industry, and it will ensure that illegal aliens cannot use ‘anchor babies’ in order to take advantage of our overly generous welfare system. I commend the President for his actions, and I am very happy that my legislation will soon be adopted by the White House as national policy.”

The operative text of the 14th Amendment reads as follows:

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

Congressman King has written extensively on the legal scholarship behind his effort to restore the original meaning of the 14th Amendment. An excerpt:

“By its own terms, the language in the amendment precludes the notion of universal automatic birthright citizenship. It would have been quite simple for the language to exclude ‘and subject to the jurisdiction thereof’ to accomplish the goal of bestowing citizenship on any child born in the United States no matter the status of their parents. The 14th Amendment’s addition of a jurisdictional requirement to the territorial requirement, however, denies any interpretation that birth alone grants citizenship.

Counter to this logic, proponents of universal automatic birthright citizenship claim that those born in the United States necessarily are subject to the jurisdiction of the country. However, this renders the language ‘subject to the jurisdiction thereof’ superfluous. Why would the drafters of the 14th Amendment include this qualifier at all if it was met simply by virtue of being born in the United States? The legislative history outlined below will make clear that the addition of ‘subject to the jurisdiction thereof’ was designed specifically to make sure the people granted citizenship did not have divided political loyalties.”

    Donald Trump revealed that he wants to end birthright citizenship through executive order….But he doesn’t have that power.
    An executive order cannot reverse the guarantee of citizenship to anyone born in the United States that is enshrined in the constitution.
    Just more BS and lies by Trump and his dumbass bigot & racist little bitch, Steve King.

    Trump’s claim that the United States is the only country the world that practices automatic citizenship for those born within a nation’s
    borders is inaccurate as 38 other countries around the globe also have birthright citizenship, including Canada.
    Once again, more ignorance displayed by Trump along with his average of over 30 lies/day professed by Trump in recent weeks.
    And you Trump supporters just eat up Trump’s fear-mongering prior to the mid-term elections….Dumbasses.

Mexico offered the caravan asylum and jobs and thousands refused the offer. The caravan’s many criminals also opened fire at the Mexican police.       In 1868, there was virtually no immigration process and no “illegal” aliens.. You lived in Ontario and liked that farm down the road in New York? You just walked over, bought it, and lived there.

      You say with certainty that the 14th amendment was meant to exclude illegal immigrants–a class of people which didn’t exist in the 1860s. Do you have some citation that supports that?

        Maybe true for Canadians but not Mexicans. Back in those days Mexicans simply could not become US citizens – and thus certainly not landowners – since they were not white.

            The meaning of white varies by time and place. Mexicans certainly were not considered white regardless of skin tone back then. It wasn’t that long ago when Italian and sometimes even Irish immigrants were considered non-white by the majority population. Meanwhile, somalis today believe they are Caucasian. Go figure…

    By Kings logic then, the 2nd amendment was not intended to protect individual gun ownership, because it would have been “quite simple” for the language to exclude ‘A well regulated Militia, being necessary to the security of a free State,’

    Realistically, birthright citizenship isn’t going to end by executive order. Still, its good the topic is brought up. Almost one fifth of the US population is Hispanic these days while Caucasians have become a minority in the county that they founded, and this is largely a product of the 14th amendment.

      California, Texas, and the rest of the southwest was founded by the Spanish and subsequently acquired by Mexico and then the US.

      My wife is Mexican-American. Her family was in San Antonio since the late 1700s, long before the illegal immigrants from the US took over Texas in the 1830s, and way before the Krauts and Norskes came to Iowa.
