Jury finds Ohio man guilty of drunk driving in Iowa

BOONE, IOWA – An Ohio man has been found guilty by an Iowa jury of drunk driving.

On April 11, 2017, a Boone County jury at the Boone County Courthouse found Case B. Kegley, 33, of Portsmouth, Ohio, guilty of Operating a Vehicle While Intoxicated in violation of Iowa Code section 321J.2. This is Case Kegley’s second offense for Operating a Vehicle While Intoxicated making the charge an Aggravated Misdemeanor. Because of the prior charge Case Kegley faces a minimum of 7 days in jail up to 2 years in prison.

The State presented evidence at trial that on October 9, 2016, officers with the City of Boone Police Department around 12:18 am stopped a vehicle traveling on the 900 block of Story Street. When the Officers made contact with Case Kegley they could smell an odor that was consistent with that of an alcoholic beverage coming off his breath. Case Kegley demonstrated impaired balance while standing and slurred speech while talking. He failed some standard field sobriety tests and refused two other tests. Case Kegley refused any breath tests.

The jury returned a guilty verdict on April 11, 2017, finding Case Kegley guilty of Operating a Vehicle While Intoxicated in violation of Iowa Code section 321J.2. To the court he admitted a prior conviction Operating a Vehicle While Intoxicated in the State of Ohio in 2016. Because of the verdict and the prior conviction Case Kegley’s charge is an Aggravated Misdemeanor increasing his possible sentence to up to two years in prison.

Assistant Boone County Attorney, Matt Speers, tried the case on behalf of the State of Iowa for the prosecution. Case Kegley was defended by a local attorney. The Boone Police Department investigated the case.
