Former Mason City woman sues Iowa City peeping tom landlord

justice2IOWA CITY – A former Mason City woman has filed a lawsuit against a peeping tom Iowa City landlord found guilty this week of invasion of privacy involving nudity.

According to court records, on December 31st, 2013, Johnson County District Court Judge Stephen Gerard ruled that 64-year-old Elwyn Gene Miller of Iowa City committed the crime of invasion of privacy involving nudity, where the defendant knowingly viewed female tenants in apartments he owns for the purpose of arousing or gratifying his sexual desire.  Miller reportedly had drilled holes in bathroom walls and attempted to watch the women as they showered.  Miller was found guilty on five of eleven counts, records show, and he awaits sentencing on February 10th in a Johnson county courtroom.  Miller faces up to one year in jail and a fine of $1,500 on each count.

A Mason City woman, Ruth LaPointe, age 22, was a tenant of Miller’s in an apartment on South Lucas Street near downtown Iowa City, where Miller’s crimes were alleged to have occurred.  Court records show that Joeseph LaPointe of Mason City, Ruth’s father, has filed a lawsuit against Miller, seeking an unknown settlement.

A jury trial is scheduled for October 14, 2014, again in Johnson county.

According to the Cedar Rapids Gazette, an attorney for Miller cross-examined Ms. LaPointe during the criminal trial, asking her “Why would you sue the defendant?”

“I wanted something from him and that something has to be money,” Lapointe said in court.

Miller also faces another lawsuit related to the invasion of privacy of his tenants, this one from an un-named former tenant.
