Local sex offender seeks appeal of prison sentence after entering voluntary guilty plea

MASON CITY – According to records, the day after being sentenced to serve up to 5 years in prison for 2nd or Subsequent Offense of Registration Violation, 29-year-old Justin Lee Moor has been appointed council to represent him in appealing his prison sentence.

Justin Moor has been held in jail since July 11th after being arrested on a warrant for one class C felony count of failing to comply with sex offender registration. The allegation was considered a class C felony under Iowa code 692A.111 due to his victim’s age listed on the sex offender registry as 0-13 years of age.

The charge was result of Justin Moor claiming to live at the Ashley Inn Motel at 3451 South Federal in Mason City, while residing at other residences in Mason City and Clear Lake.

According to online court records Justin Moor entered a voluntary negotiated guilty plea to a reduced Class D felony count of 2nd or Subsequent Offense of Sex Offender Registry Violation on October 1st.

At the sentencing hearing on Tuesday, November 13th, presiding District Court Judge Christopher C. Foy sentenced Moor to serve up to 5 years in prison on the reduced charge he had voluntarily pled guilty to on October 1st. Judge Foy also sentenced Moor to serve 190 hours of community service in lieu of a $750 fine, $262.50 surcharge, and $360.00 in attorney fees.

It is unclear where the community service would be performed with Moor’s numerous restrictions as a tier 3 sex offender.

Justin Moor was convicted as a juvenile of two counts of 2nd degree sexual abuse in Mitchell County on December 15th, 2000. The case is sealed and not available to the public, but court records show he was also charged with indecent exposure and indecent acts with a child in Cerro Gordo County that same year. Since he was a juvenile at the time the case was adjudicated. The Cerro Gordo County case lists the offenses as requiring him to register as a sex offender also, but the Iowa Sex Offender Registry does not list the additional charges at this time.

Court records show Justin Moor has been arrested numerous times in various local counties for violation of the sex offender registry and living within 2000 feet of a school zone. Some cases have been dismissed, but in the ones he was convicted of judges had been very lenient up until this last sentence. In one conviction out of Floyd County Judge Christopher Foy sentenced him to just 19 hours in jail.

Moor remains in the custody of the Cerro Gordo County Jail.
