MASON CITY – A man who broke into a Mason City residence and assaulted a female occupant has escaped a potential minimum seventeen and a half years prison sentence after plea bargaining the original class B forcible felony count of 1st degree burglary down to a lessor Class C felony charge of 2nd degree burglary.
Originally, 31-year-old Michael Eric Graham, who says he is from Detroit but has lived in North Iowa for a number of years, was charged for a November 1st incident with a class B forcible felony count of 1st degree burglary which carries a mandatory 25 years in prison with 70 percent required to be served and one count of aggravated domestic abuse assault – 2nd offense.
Court records show that just days before a scheduled trial, Michael Graham scheduled a plea change hearing. At the plea change hearing on April 30th, Graham entered pleas of guilt to a lesser offense of 2nd degree burglary and aggravated domestic abuse assault 2nd offence. The amended lower burglary charge was approved by Assistant Chief Judge James M. Drew.
At sentencing on Monday, July 30th, presiding District Court Judge Colleen D. Weiland sentenced Michael Graham to 10 years in prison on the amended 2nd degree burglary conviction and an additional 2 years in prison on the aggravated domestic abuse assault 2nd offence conviction. Both prison terms are to run concurrently.

Iowa Court records show his first domestic abuse assault conviction was in 2000 in Cerro Gordo County. In 2001 Graham was charged with domestic abuse assault – 2nd offense before the court dismissed the charge. By 2005 Graham was again charged with domestic abuse assault – 2nd offense but was able to plea bargain that charge to assault.
In Michael Graham’s time in Iowa he has been named on 3 search warrants and convicted of 4 assaults, 4 counts of interference with official acts, 3 counts of disorderly conduct, possession of marijuana and meth, eluding police, 2 counts of criminal trespass, 2 counts of 5th degree theft, 2 counts of driving while barred, and numerous no contact order violations.
Michael Eric Graham is currently listed on the Cerro Gordo County Sheriff’s Inmate population report as awaiting transport to prison.

The punishment should fit the crime. He should be robbed and beaten within an inch of his life. Make an example of people that come into our area and break the laws. Maybe then so many criminals wouldn’t move to this area. It’s time to clean up Mason City.

According to Anonymous he has 4 little girls who have been around him since birth, how could that be? If they are in Detroit, he’s not there. If he’s a woman beater, I would say it’s better for those four little girls that he is locked up for awhile.

Huh, sounds to me like he used all those little girls to survive off! and their mother who probly gets food benifits and title 19, not to mention HUD which puts a roof over this guys head! What an easy life! No wonder they come to the midwest! Alot of these women are doing this for these detroit/chicago boys. And many of the landlords don’t give a flying shit cause they are getting their rent monthly! Come on Mason citians start reporting this and maybe we can clean this town up. If they don’t have a place to live they can and hopefully will go on there merry way cause ya know they don’t have jobs! Laws need to be changed at the state level. Contact your rep. Toughen the laws and judges and county attorneys can’t ignore them. Some states are tightening up their budgets and reducing welfare, no use in being chumps in Iowa and continuing to fund everybody that migrates here for the great benefits we provide. Vote for reps that don’t want to keep handing stuff out until we ruin our own economy via crime and increased social problems. Please vote and vote wisely.
I believe the idea of instituting a minimum residency prior to benefits (as someone else suggested a few months ago here) has a lot of merit. It would be quite easy to implement, and does not take a lot of long acts and political maneuvering. Nor would I imagine such an act violate any Federal rules or laws.
The only hitch I can see is coming from a state that has a “portability” law on benefits once he or she has qualified. Personally I think such laws that force other states into mandates is against our Constitution.
Too bad we can’t deport lawbreakers back to their home states after their first conviction. I know. It’s not legal and people can live wherever they want to, but somehow, we need to be a state that is hostile to lawbreakers and government funding abusers. That is not the kind of population growth we need. We need industry with good law-abiding white collar and blue collar workers.

Our judges and attorneys that have dealt with this POS and many like hime should be ashamed of themselves.
