Northern Iowa man charged in Mason City with exploitation of minor faces sentencing

MASON CITY – A Northern Iowa man will be sentenced in December after he was charged by Mason City police with sexual exploitation of a minor.

On June 4, 2024, Mason City police charged 23-year-old Zackary Bodia Wagner of Fertile, Iowa, with sexual exploitation of a minor, a violation of Iowa code 728.12(2). The code states that “It shall be unlawful to knowingly promote any material visually depicting a live performance of a minor engaging in a prohibited sexual act or in the simulation of a prohibited sexual act.” This is a class C felony crime.

After a judge immediately issued a warrant, Wagner (pictured at top) managed to avoid arrest until police in Clear Lake were able to take him into custody on July 7. He was taken to the Cerro Gordo county jail and held until he posted bond on July 10.

In court, Wagner initially entered a not-guilty plea, and a trial was set. However, after his local public defender entered a number of court motions, Wagner entered a negotiated plea and will now be sentenced on December 16, 2024, at 9:30 AM.

Earlier this year on January 16, Wagner was the subject of a civil motion in court by a female, and Judge Rustin Davenport granted a petition for relief from domestic abuse. A retraining order was issued by Davenport.  The order was rescinded in March.
