DES MOINES – A Mississippi man has been charged with third-degree criminal mischief in violation of individual rights after he allegedly destroyed an alter to Baphomet that was peacefully displayed inside the Iowa Capitol building.

Michael P. Cassidy of Lauderdale, Mississippi, has been charged with third-degree criminal mischief in violation of individual rights, a class D felony, for intentionally damaging a statue owned by the Satanic Temple of Iowa. Cassidy dismantled the Baphomet Altar on Dec. 14 at the Iowa State Capitol and destroyed the headpiece, according to an Iowa State Patrol report.

Based on information from the victims, the cost to replace or repair the property is between $750 and $1,500. That amount would make the offense third-degree criminal mischief, an aggravated misdemeanor, according to Iowa Code Section 716.5.

In addition, evidence shows the defendant made statements to law enforcement and the public indicating he destroyed the property because of the victim’s religion. That enhances the charge to third-degree criminal mischief in violation of individual rights, a class D felony, according to Iowa Code Section 729A.2. Cassidy faces arraignment on Feb. 15.

In response, supporters of Baphomet released a statement:

“In a significant development, the vandalism of The Satanic Temple Iowa congregation’s Baphomet statue at the State Capitol has been elevated to a charge of felony third-degree criminal mischief and a hate crime. This shift from a mere misdemeanor to a serious felony underscores the gravity of the attack on religious pluralism and the criminal violation of essential individual rights. We appreciate the Polk County Attorney’s Office recognizing The Satanic Temple’s authentic religious standing, reinforcing our rightful place in a society that acknowledges diverse beliefs. While the path to true religious equality in America will be long and fraught with challenges, this moment marks a significant milestone in our journey. Our sincere gratitude goes out to the TST community, supporters, and allies for standing together with us. We will continue to provide updates on this case as it develops.”
