REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on January 2, 2024. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Adams, Symonds, Latham, Lee. Absent: None.

Adopt Agenda: Motion, Adams; 2nd, Masson that the agenda be adopted. AYES: All (Motion carried.)

Mayor Schickel provided a State of the City Report:

Prior to adopting the Consent Agenda Item #7, #10, and #11 were removed to be acted upon separately.

Consent Agenda: Regular Minutes of December 19, 2023; Claims dated December 21 and 28, 2024 in the amount of $1,897,152.32; The Quarry – Class C Liquor, Outdoor Service; LuLu’s Margarita Bar – Class C Liquor, Outdoor Service; Tobacco – EG Petroleum Inc., 610 S. Monroe; Appoint/hire Matthew Smith as Code Enforcement Officer at Grade I, Step 6 (29.79/hour); Resolution No. 24-1, permit the temporary closure of public ways for block parties and other temporary events in 2024; Resolution No. 24-03, approving property owner application under the 2023 Downtown West HOME Pilot Program and authorizing bidding of improvements; Resolution No. 24-04, accepting work and ordering payment for construction of the “2022-2023 Sanitary Sewer Repairs”. Motion, Jaszewski; 2nd, Latham that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

7. City Council Final Policy Agenda Work Plan: Motion, Latham; 2nd, Symonds that Resolution No. 24-2, adopting the City Council Final Policy Agenda Work Plan for Calendar Years 2024 and 2025 be adopted. Positive comments followed regarding the Worksession and the importance of building more single family housing. AYES: All (Motion carried.)

10. Notice of Bidding & Setting Hearing – 1609 S Harding Avenue: Motion, Jaszewski; 2nd, Adams that Resolution No. 24-5, (1) approving the competitive criteria and procedures for disposition of certain property located within the Mason City Unified Urban Renewal Area; (2) determining that the proposal submitted by Tracy D. Nicholson and Charity N. Nicholson satisfies the offering requirements and declaring the intent of the city to convey the property to Tracy D. Nicholson and Charity N. Nicholson in the event that no competing proposals are submitted; (3) ordering publication of a notice of competitive bidding and soliciting competing proposals; and (4) fixing date for a public hearing on the proposal to enter into a real estate purchase agreement with Tracy D. Nicholson and Charity N. Nicholson related to the conveyance of property, and providing for publication of notice thereof be adopted. Discussion followed regarding the bidding process. AYES: All (Motion carried.)

11. License Agreement – Pruess Nature Area: Motion, Symonds; 2nd, Latham that Resolution No. 24-6, approving and authorizing execution of a License Agreement between the City of Mason City Iowa and the Cerro Gordo County Conservation Board for approximately one (1) acre of land shown as Pruess Nature Area (North Illinois Avenue), be adopted. Discussion followed regarding the alignment and location and where the trail is located. AYES: All (Motion carried.)

Change Zone Z4 Multi-Use to Z6-R Restricted Industry Zoning District: The Public Hearing was held as per published notice. Comments were noted. There being no further comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Adams that the Ordinance amending Title 12 of the City Code, it being the zoning ordinance of said city, and changing the boundaries of certain districts therein zoned Z4 Multi-Use District to Z6-R Restricted Industry for property general located at 43rd Street SW and South Washington Avenue be received and placed on file for 1st Consideration. Discussion followed regarding the idea for the property and confirmation that it would not produce noise, light or odor issues. AYES: All (Motion carried.)

Rezone Newly Annexed Property to Z6-O, Open Industry: Motion, Masson; 2nd, Jaszewski that Ordinance No. 24-1, amending the City Code it being the zoning ordinance of said city, and changing the boundaries of certain districts therein unclassified to Z6-O, Open Industry Zoning District for land recently annexed to the City of Mason City, be adopted. Clarification was made that no objections had been made. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:45 p.m.
