MINUTES
REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on December 19, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds (via telephone), Adams, Latham, Lee. Absent: None.

Adopt Agenda: Motion, Jaszewski; 2nd, Masson that the agenda be adopted. AYES: All (Motion carried.)

Administrator Burnett presented the Monthly Administrative Report.

Consent Agenda: Special Minutes of November 22, 2023 and Regular Minutes of December 5, 2023; Claims dated December 7 and 14, 2023, in the amount of $2,333,949.56; Pastime Gardens – Special Class C Liquor, Outdoor Service; Class C Retail; Ransom’s – Class C Liquor License; Country Axe – Special Class C Retail; November Financial Report; Appoint/Hire Emily Carolan and John Laurin as Firefighter/Paramedic ($25.24/hour); Appoint/Hire Will Almendarez as Police Officer ($30.16/hour); Resolution No. 23-249 designating the Mason city Globe Gazette as the official newspaper for the year 2024 for the City of Mason City, Iowa; Resolution No. 23-250, adopting the City Council Policy Agenda Work Plan for calendar years 2024 and 2025; Resolution No. 23-251, levying assessments for charges on certain properties and the certification of same to the County Treasurer for collection with property taxes within the City of Mason City, Iowa; Resolution No. 23-252 authorizing the purchase and execution of a Real Estate Purchase Agreement for property locally known as 1444 N Federal Avenue; Resolution No. 23-253, award of contract to Tom Crowley of St. Ansgar, Iowa for broad-
casting and recording of Regular and Special City Council Meetings, was presented. Motion, Masson; 2nd, Jaszewski that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

Budget Amendment #2 – Fiscal Year Ending June 30, 2024: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Finance Director Hinson outlined the recommendation. Motion, Adams; 2nd, Latham that Resolution No. 23-254, amending the budget (Amendment #2) for Fiscal Year ending June 30, 2024, be adopted. Discussion followed regarding the amendments and the fund balances & General Fund. AYES: All (Motion carried.)

Change of Zone to Z6-O: Motion, Jaszewski; 2nd, Adams that the Ordinance amending the City Code it being the zoning ordinance of said city, and changing the boundaries of certain districts therein unclassified to Z6-O, Open Industry Zoning District for land recently annexed to the City of Mason City, be received and placed on file for Second Consideration. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:22 p.m.

SPECIAL MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in Special session pursuant to law and rules of said Council, in the 2nd Floor Conference Room of the City Hall, at 6:19 P.M., on November 22, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Adams, Jaszewski, Masson, Symonds, Latham, Lee (via telephone). Absent: None.

Adopt Agenda: Motion, Masson; 2nd, Jaszewski that the Agenda be adopted: AYES: All (Motion carried.)

Third Amendment to Purchase, Sale & Development Agreement – MCCCH LLC: The Mayor noted the amendment would allow for the closing of the Hotel Project, explaining this amendment would increase the number of rooms from 115 to 131 and would move the ballroom into the mall space (old Younkers area). He stated the closing was set to take place by December 20th and stressed this was a big step as the last step in River City Renaissance Project. Motion, Jaszewski; 2nd, Symonds that Resolution No. 23-244, making final determination on the sale of interest in real property and approving and authorizing execution of a Third Amendment to the Purchase, Sale and Development Agreement by and between the City of Mason City and MCCCH LLC, be adopted. Administrator Burnett outlined the changes to the Agreement. Comments and questions followed regarding the reason for moving the Ballroom, whether the connection from the hotel and ballroom would be outdoors, where the meeting spaces would be located and number of breakout rooms, when construction would start and when it would be completed, what has been paid out so far, how the escrow account worked, etc. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 6:49 P.M.
