REGULAR MEETING
OF THE CITY COUNCIL
The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on November 7, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Lee, Symonds, Adams. Absent: None.
Adopt Agenda: Motion, Symonds; 2nd, Masson that the agenda be adopted. AYES: All (Motion carried.)
The Mayor proclaimed November 12th through the 19th, 2023 as “National Apprenticeship Week” and November 11th as “Veterans Day”.
Mary Markwalter with River City Sculptures on Parade announced “Story Hour“ as the People’s Choice Award.
Prior to adopting the Consent Agenda Items #8, #10, #13, #18, #20, #21 and #23 were removed to be acted upon separately.
Consent Agenda: Regular Minutes of October 17, 2023; Claims dated October 19, 26 and November 2, 2023, in the amount of $4,347,163.25; Aldi – Class C Beer, Class B Wine; Burke’s Bar & Grill – Class C Retail, Outdoor Service; Buffalo Wild Wings – Class C Retail, Outdoor Service; Kwik Star #1027 – Class B Retail; Walsh’s Shebeen – Class C Retail; Approval of the August and September Financial Report; Appoint John Fallis to the Planning & Zoning Commission (TFV Lilian Al Haddad); Resolution No. 23-218, levying assessments for charges on certain properties and the certification of same to the County Treasurer for collection with property taxes within the City of Mason City; Resolution No. 23-220, setting a date of meeting at which it is proposed to approve a Development Agreement with the North Iowa Corridor Economic Development Corporation, including annual appropriation Tax Increment Payments; Resolution No. 23-221, accepting work and ordering payment for construction of the Sanitary Sewer CCTV Phase 4 Project; Resolution No. 23-223, accepting work and ordering payment for construction “2023 Street Panel and Curb Replacement Program Project No. 23-1002”; Resolution No. 23-224, accepting work and ordering payment for construction of the “Scrip Road Conversion Project”; Resolution No. 23-225, awarding a contract to Rite Way Lawn Service of Nora Springs, Iowa for the “2023-2024 Snow and/or Ice Removal”; Resolution No. 23-226, approving property owner applications under the 2023 Downtown West Home Pilot Program & authorizing bidding of improvements; Resolution No. 23-228, certification of population in annexed territory to the Iowa Treasurer of State; Resolution No. 23-231, approving and authorizing execution of License Agreement between the City of Mason City and the Mason City Community School District for the creation of a Mountain Bike Trail on the High School and Middle School Property. Motion, Masson; 2nd, Jaszewski that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)
8. Appoint/Hire Chief Building Official: Motion, Lee; 2nd, Adams that the recommendation to appoint Kyle Peterson as Chief Building Official (Grade L, Step 6, $38.10/hr) in the Development Services Department, be approved. Questions followed regarding electrical permits, when the individual would start and certifications. AYES: All (Motion carried.)
10.Recyclables Processing and Marketing Services Agreement: Motion, Symonds; 2nd Lee that Resolution No. 23-219, approving and authorizing execution of a Recyclables Processing and Marketing Service Agreement with Absolute Waste Removal Inc., be adopted. Discussion followed regarding the process, sorting of recyclables, etc. AYES: All (Motion carried.)
13. Final Pay – 2023 Pavement Marking Program Project No. 23-1003”: Motion, Jaszewski; 2nd, Symonds that Resolution No. 23-222, accepting work and ordering payment for construction of the “2023 Pavement Marking Program Project No. 23-1003”, be adopted. Questions followed regarding whether a penalty was imposed. AYES: All (Motion carried.)
18. Award Contract – MC Brownfields Community Wide Assessment Grant: Motion, Jaszewski; 2nd, Adams that Resolution No. 23-227, award of contract for professional services to Impact 7G for the Mason City Brownfields Community Wide Assessment Grant, be adopted. Questions followed regarding the grant. AYES: All (Motion carried.)
20. Agreement with North Iowa Corridor Housing Development Corporation: Motion, Jaszewski; 2nd, Masson that Resolution No. 23-229, approving and authorizing execution of an Economic Development Grant Agreement between the City of Mason City and the North Iowa Corridor Housing Development Corporation, be adopted. AYES: All (Motion carried.)
21. Order Hearing “28550 Bike Park and Trails – Bid Package 1”: Motion, Adams; 2nd, Symonds that Resolution No. 23-230, authorizing notice to bidders, fixing amount of bid security, and ordering Clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “28550 Bike Park and Trails – Bid Package 1”, be adopted. Comments and questions followed regarding the project. AYES: All (Motion carried.)
23. ARPA Funding for Childcare Efforts: Motion, Adams; 2nd, Symonds that Resolution No. 23-232, reappropriating funding from the City of Mason City’s American Rescue Plan Act (ARPA) funding to support childcare efforts and authorizing the release of funds to the North Iowa Corridor Economic Development Corporation, be adopted. Discussion followed regarding the Grant and how the program would work. AYES: All (Motion carried.)
Establish Urban Renewal Area & Plan Amendment: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Administrator Burnett stating there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Finance Director Hinson stated staff was missing an Ag document and requested the Council table the item to the November 21st Council Meeting. Motion, Jaszewski; 2nd, Masson that the Resolution to declare Necessity and Establish and Urban Renewal Area, pursuant to Section 403.4 of the Code of Iowa and approve Urban Renewal Plan Amendment for the Mason City Unified Urban Renewal Area, be tabled to the November 21st Council Meeting. AYES: All (Motion carried.)
14.Building Regulations– Plumbing/Mechanical Inspector Qualifications: Motion, Masson; 2nd, Jaszewski that the Ordinance amending the City Code, by repealing Title 1 “Administration”, Chapter 5 “Corporate Limits”, Section 1, “Corporate Limits”, in its entirety and adopting a new Section 1 in lieu thereof, to update the boundaries of the City of Mason City, in conjunction with annexation, be received and placed on file for First Consideration. AYES: All (Motion carried.)
