MINUTES
REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on June 6, 2023. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Jaszewski, Masson, Symonds, Thoma, Lee, Adams. Absent: None.

Adopt Agenda: Motion, Jaszewski; 2nd, Thoma that the agenda be adopted. AYES: All (Motion carried.)

The Mayor proclaimed June 10th, 2023, as “Drive the Jefferson Highway Day”.

Bill Angerman with WHKS provided a presentation on the Water Reclamation Facility Improvements Project Facility Plan – Nutrient Reduction Strategy. Finance Director Hinson and City Administrator Burnett addressed the fiscal aspects. Council comments and questions followed.

Consent Agenda: Regular Minutes of May 16, 2023; Claims dated May 18, 25 and June 1, 2023, in the amount of $2,238,270.93; Bills BBQ – Class B Beer, Class B Native Wine; Walgreens – Class B Wine/C Beer/E Liquor; Walmart – Class B Wine/C Beer/E Liquor; Northwestern – Steakhouse – Class C Liquor License; The Corner Pizza & Ale House – Class C Liquor, Outdoor Service, Living Quarters; Pipe Dream Pizza – Class C Liquor License; Lucky Wife Wine Slushies – Special Class C Retail Alcohol License 3700 4th Street SW (5 day license at Fairgrounds); April 2023 Financial Report; Reappoint Amanda Ragan to the Planning & Zoning Commission; Promote Mason City Police Officer Seth McChesney to Police Sergeant at hourly rate of $40.68; Approve 5.25% Wage Increase Non-Bargaining Employees; Resolution No. 23-121, fixing compensation for certain appointed officials for fiscal year 2023/2024, effective June 26, 2023; Resolution No. 23-117, approving and authorizing execution of amendments to the City Administrator/City Clerk Employment Agreement effective July 1, 2023; Approve Option 1 Water Reclamation Facility; Resolution No. 23-123, award of contract to WHKS & Co., for professional services related to the Water Reclamation Facility Improvements Project – Design Phase; Resolution No. 23-, award of contract for professional services to SEH for the Pennsylvania Avenue Street and Utility Improvements Project, was presented. Motion, Jaszewski; 2nd, Thoma that all items in the Consent Agenda be approved and Resolutions adopted. AYES: All (Motion carried.)

12. Workforce Housing Tax Credit Application by Dev Partners: Motion, Lee; 2nd, Masson that Resolution No. 23-124, support for an application to the Iowa Economic Development Authority for Workforce Housing Tax Credits by Dev Partners for the development of vacant property at the 100 Block of North Delaware Avenue be adopted. Comments followed regarding the deadline and turnaround time. AYES: All (Motion carried.)

13. Contract & Bond “Scrip Road Conversion Project”: Motion, Adams; 2nd, Thoma that Resolution No. 23-120, approving contract and bond for “Scrip Road Conversion” Project, be adopted. Discussion followed regarding the timeline. AYES: All (Motion carried.)

15. Change of Zone – 1007 4th Street SW: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. Comments were noted. The Public Hearing was declared closed. Motion, Jaszewski; 2nd, Thoma that the Ordinance amending Title 12 of the City Code it being the Zoning Ordinance of said city and changing the boundaries of certain districts therein zoned Z2 Sub-Urban Zoning District to Z4 Multi-Use Zoning District for property located at 1007 4th Street SW subject to the terms of the Conditional Rezoning Agreementbe received and placed on file for First Consideration. Discussion followed regarding restricted uses, possibility, future development on south side of 4th Street, etc. AYES: All (Motion carried.)

16. Change of Zone – 15 N. Taft Avenue: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Hinson replying there were no written comments and no “raised hands” via Zoom. One comment was provided There being no further comments the Public Hearing was declared closed. Motion, Adams; 2nd, Symonds that the Ordinance amending Title 12 of the City Code it being the Zoning Ordinance of said city and changing the boundaries of certain districts therein zoned Z3 General Urban Zoning District to Z4 Multi-Use Zoning District for property located at 15 North Taft Avenue subject to the terms of the Conditional Rezoning Agreementbe received and placed on file for First Consideration. Clarification was made regarding any additional comments from the neighborhood. AYES: All (Motion carried.)
17. Approval of a P2 Site Plan – Addition to the Fire Station: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Masson; 2nd, Symonds that Resolution No. 23-119, authorizing approval of a P2 Site Plan for an addition to the Fire Station located at 350 5th Street SW, be adopted. AYES: All (Motion carried.)

18. Vacate & Convey Alley – Mason City School District: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Jaszewski; 2nd, Adams that Resolution No. 23-118, vacating and conveying public property (alley) and authorizing issuance of a Quit Claim Deed to the Mason City School District in the block bounded by 26th Street SW, S. Jefferson Avenue, 27th Street SW and vacated S. Madison Avenue, be adopted. AYES: All (Motion carried.)

19. Vacate Public Property – Roadway Alignment of U.S. 65/South Federal Avenue: The Public Hearing was held as per published notice. Mayor Schickel asked if there were any written comments or objections or anyone on Zoom that would like to comment with Burnett replying there were no written comments and no “raised hands” via Zoom. There being no comments the Public Hearing was declared closed. Motion, Symonds; 2nd, Masson that Resolution No. 23-122, authorizing vacation and conveyance of public property needed to accommodate the revised roadway alignment of U.S. 65/South Federal Avenue and approval of the Iowa Department of Transportation Purchase Agreement and issuance of Quit Claim Deed as set out in this resolution below, be adopted. AYES: All (Motion carried.)

20. Mayor and City Council Member Salary Change: Motion, Lee; 2nd, Jaszewski that Ordinance A amending the City Code by repealing Title 1, Chapter 8: Municipal Officers and Employees, Section 5: Salaries of Council Members and adopting a new Section 5 in lieu thereof and B amending the City Code, by repealing Title 1, Chapter 8: Municipal Officers and Employees, Section 6: Salary of Mayor and adopting a new Section 6 in lieu thereof,be received and placed on file for First Consideration. AYES: All (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 7:48 p.m.
