Iowa man faces prison for punching woman in the face

BOONE, IOWA – An Iowa man accused of numerous assaults has been found guilty of punching a woman in the face, and now faces prison.

On October 3, 2017, a Boone County jury found Lee David Henry Bookout, 33, of Ogden, Iowa, guilty of Domestic Assault in violation of Iowa Code section 708.2A. Because this is Lee Bookout’s 3rd or Subsequent conviction for Domestic Assault he now faces up to five years in prison with the Iowa Department of Corrections.
According to the testimony at trial, on June 22, 2017 at about 3:13 am, the Boone County Sheriff’s Dispatch received a 911 call from Lee Bookout’s cohabitating girlfriend sounding very upset stated that Lee Bookout struck her in the face. Ogden police responded to the location. Officers investigated noting injuries on the victim’s face consistent with her reporting. The victim reported to officers that Lee Bookout struck her in the face with his fist and left when she called police. Officers found Lee Bookout later where he denied the assault happened.

The jury found Lee Henry Bookout guilty of Domestic Assault in violation of Iowa Code section 708.2A. A sentencing date for the conviction will be held at a later date. As a result of the verdict and his criminal history Lee Bookout the court remanded Mr. Bookout into custody with the Boone County Jail.

According to public sources and a records check revealed that Lee Bookout had five prior convictions of assault:

• On April 13, 2006 he received a deferred judgment on Domestic Assault that was later violated and he was convicted on the case on May 7, 2007.
• On September 19, 2006 he was convicted of Domestic Assault in Polk County.
• On August 22, 2007 he was convicted of Domestic Assault in Guthrie County by a jury where he was sentenced to five years in prison.
• On April 18, 2011 Lee Bookout was convicted of Assault Causing Bodily Injury in Guthrie County serving 60 days in jail.
• On May 22, 2017 in Guthrie County he was convicted of Assault.

The Guthrie County Assault was perpetrator by Lee Bookout on the same victim. The Iowa Supreme Court and other Appellate Courts have held that these prior assaults on the same victim are normally admissible as evidence in cases however the Judge in this case refused to allow prior violence to the victim to be admissible. Despite the jury not hearing about the prior violent record, the jury found Lee Bookout guilty of Domestic Assault. Since this is his 3rd or Subsequent Domestic Assault he now faces a minimum of one year in prison and up to five years in prison with the Iowa Department of Corrections.

First Assistant Boone County Attorney, Matt Speers, tried the case on behalf of the State of Iowa for the prosecution. Lee Bookout was defended by a local attorney. The Ogden Police Department with the Boone County Sheriff’s Office investigated the case.
