Clear Lake council implements ban on discharging fireworks

CLEAR LAKE – At a special City Council meeting on Tuesday, May 30th, the Clear Lake City Council, voted unanimously (Council Member Ebeling absent) to prohibit the use of Class 1 Consumer Fireworks in the City limits. The Council amended City Administrator, Scott Flory’s proposed Ordinance, which would have allowed the use of fireworks on the 3rd, 4th, and 5th, to a complete ban on class 1 Consumer Fireworks.

The sale of Class 1 Consumer fireworks was also amended by the Council to only be permitted in the areas of the City zoned heavy industrial.

The meeting was extensive and lasted till 8 o’clock on that topic primarily, NIT is told by this win attendance.

Under State law, cities cannot prohibit the sale, but can restrict the locations of sales through zoning. Also, local governments were given discretion under the State law to limit the use of fireworks.

The law is effective once the Ordinance is published in the newspaper on June 7.

For the last 40+ years I have seen them shooting arials all around the lake. Don’t read that many people getting charged. So are they going to enforce this law any better than the ones on the books now?

This does not surprise me with all the phony demorats on the city council – these people are not the Hamptons – more like the Clinton gang of crooks.

I approve of this action. Fireworks are often confused for the sound of gunshots, and vice versa. We cannot have a society which allows startling, unexpected noises of this nature to pollute the general welfare and serenity of the community. Loud pipes emitting from illegally equipped motorcycles and pickup trucks should also be addressed. WE simply cannot one group of humans to overpower and dominate the other group, especially when aggravation and menace are at play. The city Council has taken a long time to grow up, and they owe me an apology for their delay in doing so.

What a bunch of dumb comments. What I take away from all the whining is, you people want no laws, no boundaries, and everyone should just run wild and make all the noise and disturbance you want.

I am in favor of the ordinance that Clear Lake has put into effect.

I like some fireworks but if you want to set off fireworks then go do it somewhere your not causing trouble and problems for your neighbors. Clearly without this new ordinance in Clear Lake there will be plenty of trouble.

Sad to say, but it is true there are too many irresponsible people that ruin it for the rest that creates the need for this new law in Clear Lake. I hope Mason City follows suit.

I really like how everyone loves to live in fear of everything. Always thinking the worst of ever situation. It’s sad that the general public allows this to happen. One day a year would not be too much to ask for, for God’s sake, to celebrate our country’s national birthdate. It’s similar to banning peanut butter in a school of hundreds because one person is allergic to it. I guess the fear mongers rule the country now. So sad.

Your example of peanut butter is nowhere near what this issue involves. The region I live in has occasional drive-by shootings, where thugs are literally shooting into homes and apartment buildings randomly. The bullets penetrate through the flimsy drywall and reach the other sides of walls within interior rooms. When people are randomly shooting off fireworks, they confuse the listener as to what is the sound of gunfire and what is fireworks. I personally had to construct a brick wall on the interior of my apartment to protect against these random shootings. Clear Lake may not be as violent a region where I reside, but it still allows an unsavory occurrence to happen, and instead of phoning the police to report a gunshot, grandma could continue watching Murder She Wrote, thinking it’s just another one of those “damn hooligans firing off fireworks again”. Keep the peace, and only allow celebrations at prescribed times during the year.

Sneaky Pete is an outer wear handgun case which resembles a leather square worn on the belt. I’ve seen several guys wearing them around town, and they are obvious for those of us who know what they are. I have to say, with the exception of a few D-baggers, most people drive their vehicles and motorcycles reasonably. Someday you may confess your sins to me with thine own lips, but until that day, you are living in a state of excommunication.

Tha’ts just like the cruise around the lake – is it true you have to have a cop in each car. – No fun anymore – stick your lake and your sheeple laws and stick them where the sun don’t shine. Is it still a law that you cannot drink a brew while boating – OH! that’s really a fun event . NOT!

All I can say is I hope law enforcement is going up and down Lake Shore Drive handing out tickets to all houses on the lake that are lighting fireworks. LOL

this ordinance, like most others, is there to allow government employees (DNR, police, Hwy patrol, sheriff, etc ) to raise Dollars for the state. They are paid huge dollars, and generate huge dollars.

Allen, what he was referring to is that Clear Lake is to Mason City as “the Hamptons” on Long Island NY are to the rest of New York City.
The Hamptons are a very exclusive & expensive area of New York City and with a median home sale price of $8.5 million.

It’s obvious to me that the clear lake city council doesn’t think that there are any intelligent people that can use fireworks safely in clear lake, and, to a certain extent, they’re probably right. As for the cruise around the lake, that’s sad, because there always has to be at least one bad apple that will spoil it (fun) for everybody. My suggestion is, if you don’t like the rules that the clear lake council puts out, don’t go there to spend your money. Alcohol, gun powder, and gasoline, just don’t mix.

now mason city needs to follow, besides the PTSD there are pets which go histerical when they hear the bang. wonder how many kids will go to the ER and how many house fires there will be from rockets landing on roofs
