IOWA FALLS – An Iowa Falls man facing charges of felony sexual abuse and possession of child pornography claims he is not guilty and will stand trial in July.
Gary Havens, age 71 of Iowa Falls has been charged by the Hardin county sheriff and Iowa Falls police with five crimes. He faces charges of felony B sexual abuse in the second-degree from 2008 and 2015.
In addition, he faces three counts of first-offense purchase/possess depiction of minor in sex act. Iowa code 728.12(3) states that it shall be unlawful to knowingly purchase or possess a negative, slide, book, magazine, computer, computer disk, or other print or visual medium, or an electronic, magnetic, or optical storage system, or any other type of storage system which depicts a minor engaging in a prohibited sexual act or the simulation of a prohibited sexual act. A person who commits a violation of this subsection commits an aggravated misdemeanor for a first offense.
Reportedly, Havens was playing tag with a 5-year-old girl when he touched her under her pants.
Records show Iowa Falls police arrested Havens on February 3 on warrants. He was jailed on $100,000.00 cash or surety bond; he was released the next day.
He was denied a court-appointed attorney and is now scheduled for trial on July 11.
