Mason City woman in trouble for throwing boyfriend’s gun in the trash

MASON CITY – A Mason City woman who wasn’t getting along with her boyfriend took his handgun and ammo and threw it into the trash – but she didn’t get away with it.

Mason City police tell NIT that on or around December 16, 2015, 28-year-old Nicole Marie Orozco is accused of intentionally discarding her boyfriend’s handgun in the garbage. The garbage was apparently taken to landfill before the theft was noticed. The value of the handgun and ammunition was $450.00. Orozco did not live with her boyfriend at time of the theft. Mason City police applied for an arrest warrant for Orozco for the theft.

A few days later, on the afternoon of December 21, 2015, police were called to a domestic incident at 830 12 Street NE. Police say they responded to a physical domestic incident “with injury”, but they arrested the alleged victim, Orozco, who had been wanted for several days on the theft warrant.

Police further explain that Iowa Code 714 defines theft in a few forms to include: Taking possession of someone else’s property with intent to permanently deprive the owner thereof; misappropriation of property in trust and using or disposing of said property inconsistent with trust.

“The gun has been entered as stolen but never recovered as far as we know,” police said. It could be in the landfill, loaded.

In August, Orozco pleaded guilty to fourth-degree theft and was given a deferred judgment, meaning, if she stays clean through her one-year of probation, he record is wiped clean. She was also ordered to pay $1,368.50 in fines, court fees and restitution.

However, Orozco wasted little time since her guilty plea in violating her probation and being found guilty of that, and then once again violating her probation. Cerro Gordo deputies went to her house Wednesday afternoon on an arrest warrant and found her there and took her into custody. She was taken to the county jail and remains held there on $2,000 bond as she awaits a court date on October 17.
