GARNER – A state legislator from Garner has pled not guilty to a charge of 3rd Degree Sexual Abuse.

Henry Rayhons, age 78, is the House District 8 state representative. He was charged last month to one count of 3rd Degree Sexual Abuse, a class C felony. On September 17, Rayhons pled not guilty. He will face an arraignment on October 17.

Rayhons is accused of sexually abusing his wife, Donna Lou Rayhons, on May 23rd when she was a resident at the Concord Care Center in Garner. A criminal complaint states that Rayhons was told a week before the incident allegedly took place at a care conference with care center staff and his wife’s family that she did not have the cognitive ability to consent to any sexual activity. An arraignment hearing was scheduled for October 7th but online court records show Rayhons entered a not guilty plea on Wednesday. No trial date has been set. Third-degree sexual abuse is punishable by up to ten years in prison.

Rayhons has already announced that he would not seek re-election to the Iowa House of Representatives in November.
