CLEAR LAKE – A day in court, facing a charge of second offense operating while under the influence for a second time, wasn’t enough to deter a Clear Lake man from doing the deed again later that night.
David Wayne Foote, age 54, was stopped by Clear Lake police on Thursday, July 3 at about 9:00 PM. The arresting officer determined that Foote was intoxicated, and placed him under arrest. Foote refused a breath alcohol test at the scene. The officer took him to the Cerro Gordo County Jail, and was held on $11,000 cash or surety bond. He soon posted 10% ($1,100) bond and was released from jail.
Earlier Thursday morning, at 8:30 AM, Foote appeared in Cerro Gordo district court on a charge of second offense operating under the influence for a preliminary hearing. He had been stopped by the Iowa State Patrol on June 14, 2014. Judge Karen Salic set an arraignment hearing for July 21 in that case.
Foote was charged with second offense operating under the influence in 2007 after he was stopped and arrested by the Iowa State Patrol. He later pled guilty to that charge.

This is all part of the State racket to rake in millions of dollars while continuing the hypocritical double standard message: “pick up the gun, stay away from the gun.” Bombarded with television ads promoting “the good life”, the BAC level is so vague and difficult to discern, that stopping off to your local microbrewery puts you at risk of a DUI after only 2 beers. The State makes money 3x…permits, taxes, and fines. It’s not fun to go out any more.
It’s not fun because the next time you get an OWI it will be a felony, 3rd one right, and you still don’t understand the BAC? Just stay at home and drink in your mother’s basement Peter.
You should try going out with friends sometime. It tends to be more fun. You could even designate a sober driver. Maybe you could just have your mom come pick you up? It’s not like she has to make two stops on the way home.
