Sex offender who once escaped gets another chance at Beje Clark

MASON CITY – On Friday, August 31st, convicted sex offender David John Banak was granted work release and transferred from Iowa’s Oakdale Prison to Mason City’s Beje Clark.

In 2005 Banak was charged in Winnebago County with one class C felony count of 2nd degree burglary and one class C felony count of 3rd degree sexual abuse. While awaiting court proceedings Banak fled the State of Iowa. Banak was later captured and extradited from Pennsylvania to face the criminal charges.

Banak was eventually found guilty of the 2nd degree burglary charge and received up to 10 years in prison on May 26, 2006. The 3rd degree sexual abuse charge was amended to an aggravated misdemeanor count of indecent exposure to a minor. Banak received up to two years in prison on the amended charge and was required to register as a sex offender per Iowa Code.

Banak was transferred from prison to Beje Clark’s work release program on August 26, 2010 after serving 4 years 3 months on his convictions. By March 30th, 2011 he was reported escaped from Beje Clark’s custody. Banak was later captured in Lake County, Illinois in July of 2011 and transported back to Cerro Gordo County.

Once back in Iowa custody Banak was sent back to prison for the escape.

On Friday, August 31st, Banak was transferred from Oakdale Prison back to Beje Clark’s work release program.
