Johnson County massage therapist could be disciplined following client assault

An Johnson County-based massage therapist is scheduled next month to go before the Iowa Board of Massage Therapy for a disciplinary hearing after pleading guilty to allegations that he put his mouth on a client’s breast at the end of a massage session.

David Scott Martindale, 41, of Iowa City, was charged in November with simple assault after authorities said that he violated a client during a massage on June 19, 2011, at his Coralville-based studio, Martindale Therapeutic Massage.

Martindale pleaded guilty on March 9 and was given a deferred judgment, meaning his record would be cleared if he stayed out of trouble for an 18-month probationary period. The judge stipulated at the time of the judgment that he would be required to file probation review reports, and failure to do so would constitute a probation violation.

Online court records show that Martindale has a probation revocation hearing scheduled in Johnson County District Court on Sept. 7. His disciplinary hearing before the state board in Des Moines is scheduled on Sept. 25.

Martindale’s massage therapist license is currently active and is scheduled to expire on Dec. 15, according to the Iowa Department of Public Health.

His criminal history in Iowa is limited but includes two convictions for supplying alcohol to a minor – an employee – in October and May, according to online court records.

Martindale did not immediately return a call from The Gazette on Tuesday afternoon.
