FARGO—U.S. Attorney Timothy Q. Purdon announced that on June 1, 2012, Allen Herbert Demarce, Sr., of Tokio, North Dakota, pleaded guilty before U.S. District Judge Ralph R. Erickson to a charge of child abuse and neglect in Indian Country.
Demarce Sr., 28, pleaded guilty to assaulting a 2-year-old child by striking him with an open hand, resulting in bodily injury to the child’s face, arms, and back. The incident occurred in March of 2011 on the Spirit Lake Indian Reservation.
The charge of child abuse and neglect in Indian Country carries a statutory maximum penalty of 10 years’ imprisonment.
The case was investigated by the Federal Bureau of Investigation.
Sentencing for Demarce Sr. has been scheduled for August 27, 2012, in U.S. District Court in Fargo, North Dakota, at 11 a.m.
Assistant U.S. Attorney Janice M. Morley is prosecuting the case.
