KS man, 26, convicted of producing child porn

A 26-year-old Wichita man has been found guilty of producing child pornography, U.S. Attorney Barry Grissom said Friday.

Federal jurors convicted Shane M. McClelland on one count of enticing a teenage girl to send him sexually explicit photos of herself. He was acquitted on a second count of enticing another teenage girl to do the same.

In the same case, McClelland pleaded guilty last year to collecting nude pictures of two teens from New York. But his request to withdraw his plea was granted by a judge before sentencing and a jury trial was set, U.S. Attorney spokesman Jim Cross said. The jury then found him guilty of producing child porn and acquitted him on the other count.

On Aug. 9, 2010, investigators for the Wichita Police Department and the Exploited and Missing Child Unit served a search warrant at McClelland’s home, where they seized evidence of the crime.

During trial, prosecutors presented chat logs found on the computer of a 14-year-old girl in New York, as well as e-mails found in McClelland’s Yahoo account. The evidence showed that over the course of several days he pressured and persuaded the girl to send nude photos of herself.

The evidence also showed McClelland used a webcam during his chats with the girl. At trial, the girl identified McClelland from the webcam as well as pictures he had sent her during the chats.

At the time of the offense, McClelland was on parole for sexually assaulting a 12-year-old girl. He had been paroled in May 2009 after spending nearly four years in prison on a conviction of aggravated indecent liberties with a child.

Sentencing will be set for a later date. He faces a potential mandatory minimum sentence of 25 years and a possibility of a life sentence. When he pleaded guilty, he had a plea agreement for a sentence of 262 months – or nearly 22 years.
