Mason City man sentenced to nine months in county jail

A Mason City man avoided having another burglary conviction added to his criminal record after a negotiated voluntary guilty plea two weeks before going to trial.

37-year-old Chad Jay Hutzell had faced a potential ten year prison sentence if the state could have proved its case in a trial scheduled for February 14th on a class c felony count of 2nd degree burglary.

The charge followed an incident the night of October 24th of 2011 when Mason City Police were originally dispatched for a harassment call. Officers ended up arresting Hutzell for burglary and transported him to Cerro Gordo County jail where he has remained in custody.

Court records show Hutzell entered a negotiated voluntary plea to an amended serious misdemeanor count of trespass resulting in injury or property damage on Monday, January 30th.

On Tuesday, January 31st, Judge James Drew sentenced Hutzell to nine months in the county jail with work release granted. Judge Drew suspended a $315 criminal fine, but imposed a $125 law enforcement initiative surcharge, $100 criminal docket filing fee, $40 for court reporter services, and $77 in local sheriff fees.

Records show Hutzell has been convicted of 3rd degree burglary, attempted 2nd degree burglary, 3rd degree theft, and voluntary absence from custody while sentenced to Beje Clark.

According to the Cerro Gordo County Sheriff’s inmate population report Hutzel is scheduled to be released on May 27th. A protective no contact order has been extended until January 31st, 2013.
