Waterloo man charged with assault after chasing cops with a gun

WATERLOO – A Waterloo man is suffering from gunshot wounds in a hospital as he is charged with assault after chasing cops with a gun this week.

On Wednesday, April 7th, 2021, at approximately 12:45 AM, Blackhawk County dispatch received a report of a male with a long gun on or near the 6th Street Bridge in Waterloo. Two deputies with the Blackhawk County Sheriff’s Office arrived in the area. As they made contact with the male, he pointed the weapon at the initial deputy at hip level and chased after the deputy. A responding Waterloo Police Officer observed what was occurring and fired at the male, striking him twice. The male was taken to Allen Memorial Hospital for treatment for his injuries and later transported to University of Iowa Hospitals and Clinics (UIHC). The officer and deputies were uninjured.

The Iowa Division of Criminal Investigation (DCI) was requested to investigate the circumstances surrounding the use of lethal force during this incident, as is standard procedure for officer involved shootings.

On Thursday, April 8th, 2021, DCI Agents charged 44-year-old Marcelino Alvarez-Victoriano, of Waterloo, Iowa, with two counts of Assault on a Peace Officer for his actions which led to him being shot during this incident. Warrants were issued for Alvarez-Victorano’s arrest. Alvarez-Victoriano remains hospitalized at UIHC. Upon his release, he will be transported to the Black Hawk County Jail on the aforementioned warrants.

The DCI investigation into this incident is still ongoing and as a result, the names of the deputies and officers involved will not be released at this time. The results of this investigation will be forwarded to the Black Hawk County Attorney’s Office for their review.

The DCI was assisted by the Waterloo Police Department, the Black Hawk County Sheriff’s Office, and the Black Hawk County Attorney’s Office.
