Supreme Court revives transgender military ban; Iowa LGBTQ group protests

DES MOINES — Tuesday, the Supreme Court reinstated the Trump Administration’s ban on transgender military service members by lifting two lower court injunctions that had blocked the president’s policy from taking effect. Legal challenges to the ban will continue in the federal courts.

The vote was 5 to 4, with Justices Ruth Bader Ginsburg, Stephen G. Breyer, Sonia Sotomayor and Elena Kagan dissenting.

One Iowa is a statewide LGBTQ organization working to preserve and advance the rights of lesbian, gay, bisexual, transgender and queer/questioning (LGBTQ) Iowans through grassroots efforts, education and advocacy. Executive Director Daniel Hoffman-Zinnel issued the following statement condemning the Supreme Court’s decision:

“Lifting the injunctions on this discriminatory ban – even temporarily – is a slap in the face of the brave transgender service members and veterans who have served and are serving our country. Anyone who meets military standards should be able to serve, and transgender service members seek only to be evaluated on the same standards as anyone else.

According to studies by the Williams Institute and the Veterans Health Administration, transgender people are far more likely to serve in the military than the general population. Transgender people have served the United States with honor, and transgender recruits have demonstrated their fitness to serve. They deserve our respect and gratitude, not this cruel ban.

The military’s own research has shown that this ban would weaken our armed forces. It means losing qualified, trained service members and depriving the military of qualified recruits at a time when enlistment numbers are low.

This ban is based on discrimination, not facts. Multiple courts have recognized this, and the Supreme Court of the United States should be one of them.”
