MASON CITY – The Auditor of the State of Iowa today released a bombshell report that alleges over $2.2 million of improper disbursements in the Mason City School District under former Superintendents Anita Micich and Mike Penca.
The Cerro Gordo County Attorney’s Office has been notified of possible crimes in the matter and the public awaits any potential actions by County Attorney Carlyle Dalen.
A source close to the Mason City School District told NIT this morning, “And now the public can understand why Mike Penca was not selected as the School Superintendent after Anita Micich left. He was doing what Micich mentored him to do: Give himself and his top administrative staff Jodie Anderson and John Berg raises that the School Board did not approve.”
Auditor of State Mary Mosiman today released a report on a special investigation of the Mason City Community School District (MCCSD) for the period July 1, 2009 through August 31, 2017. The special investigation was requested by MCCSD officials as a result of concerns identified with the allocation of salary increases approved by the MCCSD Board of Education (Board) and contributions to certain tax-sheltered annuity (TSA) accounts. These concerns were communicated to the Office of Auditor of State during a meeting preceding issuance of the report on the reaudit of the District’s audit report for fiscal year 2015 issued August 21, 2017.
Mosiman reported the special investigation identified $2,238,952.08 of improper disbursements comprised of $108,673.24 identified in the report on the reaudit and $2,130,278.84 identified in this report. The $2,238,952.08 of improper disbursements identified includes $1,344,314.30 of contract salary issued to various MCCSD administrators, $217,405.64 for MCCSD’s share of FICA and IPERS on the improper payroll, $387,682.09 of MCCSD contributions to TSA accounts for various administrators, $171,998.36 for the resignation package awarded to the former Superintendent, Dr. Anita Micich, and $117,551.69 of vacation balance payouts to various MCCSD administrators.
The $1,344,314.30 of improper contract salary identified is comprised of actual salary issued to 66 employees which exceeded the authorized salary calculated using the percentage increases approved by the Board and other monetary benefits, such as vehicle allowances and cell phone allowances, awarded to employees without a provision in their contract and/or approval by the Board.
Mosiman also reported the Superintendent position held by Dr. Micich was shared between MCCSD and the Clear Lake Community School District (Clear Lake CSD) for the period July 1, 2010 through June 30, 2016. As part of that sharing agreement, MCCSD billed Clear Lake CSD for its portion of Dr. Micich’s salary and benefits. Based on a comparison of the percentage to be billed in accordance with the sharing agreement to the amount actually billed, $7,370.00 of overbillings from MCCSD to Clear Lake CSD were identified. Clear Lake CSD paid MCCSD for all billings received.
The report includes recommendations to strengthen MCCSD’s internal controls and overall operations, such as improving segregation of duties, ensuring all service contracts are reviewed and approved by the Board, reviewing various Board policies to ensure they are appropriate, complete, and properly followed. In addition, the Board, or a designated Board member, should perform an independent review of payroll to ensure approved salary increases are properly calculated and applied.
Copies of the report have been filed with the Division of Criminal Investigation, the Cerro Gordo County Attorney’s Office, and the Attorney General’s Office.

Statement from Dave Versteeg, Superintendent of Mason City Schools, on the Audit Report:
Auditor of State Mary Mosiman has released a special investigation report on the Mason City Community School District conducted for the period of July 1, 2009 through August 31, 2017. The special investigation report includes a summary of findings and recommended control procedures from the Office of Auditor of State to the District.
The special investigation was requested by the Board based on the findings and recommendations of the re-audit of the district released on August 18, 2017. This comes from the Board’s commitment to establish policies and to ensure open and accountable processes especially related to financial matters.
The investigation report is based on issues uncovered in the August 18, 2017 re-audit report. The results of this special investigation did not uncover any misappropriations after July 1, 2017. The core issues in the findings of the special investigation were corrected in July of 2017 as a result of the re-audit. The State Auditor confirmed that the district has taken appropriate corrective action.
Upon receipt of the Auditor of the State special investigation report, the district asked the Auditor to reconsider the following items before its release. The Office of the Auditor of the State indicated it was unwilling to meet these requests:
o The propriety of the superintendent separation agreement in 2016. The district contends that the separation agreement was appropriate based on the terms of the legally binding service contract with the superintendent and that no improper payments were made to the Superintendent as part of the separation agreement.
o The claimed overpayment by Clear Lake CSD for the superintendent sharing agreement between 2010 and 2015. Also, the district requested a review of all sharing agreements between the two districts during this same time period, but this request was declined.
o The use of the words “overpayment” and “underpayment”. Employees were paid only for work which they did perform. In the case of almost all employees whose names are listed, any errors in the payments which they received were due to procedural shortcomings on the part of the district and the State Auditor has acknowledged that these shortcomings have been corrected.
o The inclusion of the names of non-administrative employees who were improperly paid. Including the names of employees who had no decision-making power, influence or authority in determining their pay. These non-administrative employees were not the focus of the investigation.
o Payments to administrators who received $600 stipends in 2010. These payments were not made from the Phase II grant but were appropriately paid from the district’s general fund so as to keep administrator pay proportional to teacher pay in 2010.

The role of the Mason City Community School District Board of Education is to oversee the school district and to enact policy with the force and effect of law for the management and operation of the school district. The Board is taking responsibility to correct the issues uncovered and to ensure policies, state requirements, and best practices will be implemented and followed.
The Board of Education will hold its regular Committee of the Whole work/study session on Monday, January 7, 2018, in the Board Room of the Administrative Center located at 1515 S. Pennsylvania Ave., at 5:30 p.m. The Board will discuss the special investigation report in open session at this meeting and welcomes questions and comments from the public during this agenda item of the meeting.

Save one wag of your finger for yourself. School board meetings are open to the public (you). Documents they produce are available to the public (you). The public (you) can FOIA documents that a public entity refuses to hand over. School bard members are elected by the public (you).
Then, there are those the public (you) vote for to represent your interests on the school board. When the public (you) engage your elected representatives at school board meetings and/or via email-phone calls, etc., you learn more and hold them accountable.
1. Those who perpetrate a fraud should be held accountable – claw back their illegitimate gains – perhaps face legal liability;
2. Those elected to create policy and provide oversight should be held accountable at the ballot box – in the court of public opinion, and if complicit in the fraud – in the court of legal justice;

Question: I’m wondering how former Superintendent Micich kept the Mason City Board of Education distracted? Did she place video games in the board room, card games, arts & crafts, sing songs, food, drinks of all sorts, did she hire clowns to keep the Mason City Board of Education occupied while she wove her crooked, evil, misdeeds? I imagine this, with a little knowledge of the situation. First, Micich goes back and forth from MC to Clear Lake, Board Members are regular citizens and do not have offices at School. Some former Bd. Members were not willing to look at the possibility of wrongdoing and or just plain naive. There were so many lackeys surrounding Micich in Administrative positions, it was like they were co-conspirators. Micich, with her flamboyant personality, had people fooled.
Most Board Members have no training or background in accounting or finance. They have a fiduciary responsibility to protect the Taxpayers dollars, but as I stated, few Bd. Members had the knowledge. When the community finally voted for a Financial Expert, Jodi Draper, she took her responsibility seriously in reviewing the financials, board meeting minutes and related materials. And due to the Audit, we are where we are now. That ‘s just one opinion, but it seems logical.

Furthermore, if the good people of Mason City are able to read the state auditor recommendations so can any board member. You don’t need a finance degree to be on the MCCSD Board of Ed. If the school board is being advised to smear its workers who have grievanaces by whomever, it’s not working. It’s coming across very poorly. It’s vitial that the board takes it lumps and admit their failure with giving so much power to a Superintendent and her little helpers, the Assistant Superintendent, good ol’ Hal Minear, and the head of all the school finances Ramona Jeffrey. Ramona without so much as a fiancé degree yet was the highest paid in the entire state of Iowa. And of course, with Mason City being the only school district of our size to even have an Assistant superintendent.
I see we are making headlines all around the region. What a positive way to make Mason City appear to be a great place to live and work.

I absolutely agree. Anyone who took funds improperly should have to pay it back with charges filed. Complaints filed with the BOEE. Even if it was a legitimate clerical error the funds need to be paid back. But for MCCSD Board of Ed. to selectively decided this one should pay and these don’t have to, in my opinion, gives creedance to retaliatory claims. I’m very skeptical that a board member who was a past economics teacher for the school district couldn’t figure out spread sheet reports or read and decifer yearly audit reports? Did he even read them? And what about the other board business leaders? I’m truly scratching my head. Things are just not adding up.
Up until the last few years, the board was asleep at the wheel and operated more like a social club. They didn’t keep a good check on the school administrators and when challenged at school board meetings, were not responsive to the public. A new board changed all this, the public wised up and new responsible board members where voted in. Thus, all these discoveries. The school officials had all kinds of local support including from local media, especially the Globe Gazette.
It took a lot of change on the board before corrective actions were taken. I hope anyone that knowingly cheated the taxpayer is punished to the fullest extent of the law. It is very hard for me to believe that the administrators, Finance Director, HR director didn’t know exactly what they were doing. I just hope our country attorney is aggressive on this one. There is a school official in Waukee I believe sitting in a jail cell right now after an investigation showed he improperly spent public money. Same should apply here.

It’s not adding up that the MCCSD Board of Ed had NO knowledge of ANYTHING— They apparently gave Micich, carte blanche.
The state auditor seems to smell something is very off too to make a note such as this: “Finally, the report urged the board to “exercise due care” when making any decisions that would affect the school district as a whole.”
And, MCCSD Board of Ed. is objecting to this? The School Board is effectively saying we reserves the right to continue on as we please at the district/community’s expense.
Why did they pay Micich off and give her glowing recommendations? Also, AGREEING to NOT go after her litigation wise?
One has to ask themselves, why did the MCCSD School Board not let Micich continue on with her final year and simply take the option of not renewing her contract? Then take full recourse.
Also, why do they not want to pursue any overpayments that were made and expect them to be paid back? (After all, these amounts could be retracted through any IPERS, Stocks & Mutual Funds that are apart of these individual’s contracts, besides simply garnishing their wages.)
Why would they want to continue employment with people who received more than $10,000 in overpayments and benefits that they were not entitled to? Why not simply NOT renew each of their contracts?
Zeroing out the books with purchase orders and bonuses is “cooking the books” and then the audacity of telling the public they are in dire need of more funding.
It would seem to be a logical conclusion that MCCSD Board of Education may very well have more skeletons (or a lot more) that they are worried will come to light.

How is it that Joel Everist is able to be full time choral director at Waldorf College and still be employed full time in the MC School District. Aren’t his contract hours around 8am-4pm? How is he able to work full time at a college as well?
The people who voted Republican in Iowa over the past few years can answer that. The Iowa House, Senate and Governor are all Republicans. Last year they reduced bargaining rights of teachers (and other public employees) and are allowing school districts to conduct their hiring as they see fit. If they really want an employee on their faculty, they can offer extras such as reduced hours or increased pay. Everist is respected in his field and nationally recognized. Perhaps MC wants to keep him and this is a way to do so. He probably isn’t overpaid.
MC schools is in their 2nd year of their 2 year contract so they can NOT offer reduced hours….. so Mr. Everist has no businsss nor right to be allowed to leave the high school early to go to Waldorf.

action?” After consulting with members of the committee who wrote this bill, the BOEE has determined that the employee discipline that must be reported to the BOEE includes written reprimands, written warnings, job separation agreements, resignations, nonrenewals, or terminations that resulted from employee misconduct covered by the mandatory reporting areas. The mandatory reporting discipline areas are listed below:
(a) Soliciting, encouraging, or consummating a romantic or otherwise inappropriate relationship with a student.
(b) Falsifying student grades, test scores, or other official information or material. (c) Converting public property or funds to the personal use of the school employee.
(d) Being on school premises or at a school-sponsored activity involving students while under the influence of, possessing, using, or consuming illegal drugs, unauthorized drugs, or alcohol.

This is the tip of the iceberg!!!! The DCI should review the Mason City Chambers financials (business trip that are really personal vacations) and all government spending. Someone needs to report them to the proper orgininzation and get this same audit/review process going.

You have no idea what you are talking about and never have. The school year starts in the middle of August and ends early in June. Most teachers either work a second job or return to school to increase their understanding of the subject matter or the student. As far as “huge” benefits and wages for the work, who else is entrusted with protecting and instructing our children? Not just one or two at a time, but 30-35 per hour for 8 hours a day. Baby sitting that many kids a day would pay at least twice what the current teachers receive. You think it is such an easy job, why didn’t you get into it?

Not only were these administrators overpaid, there are way to many of them for the number of school children today. I somewhat agree that some teachers are underpaid, but some are way overpaid too.
School boards now have the legal right to set salaries as they choose as the majority of the collective bargaining agreement between the teachers and the state has been removed. If you don’t think a teacher is earning an amount he or she deserves, then the board can do something about it. If you think a teacher is paid too much, take your reasons to the board and ask them to do something about it.

Thieves. Please compare payments to books, uniforms, trips and other costs that were denied during the same time frame. Any school board member still serving who served during the time frame should also be forced to step down.
