WASHINGTON, D.C. – President Donald Trump doesn’t want persons from volatile, rogue nations coming to America and imposed a travel ban, and that ban was approved by the U.S. Supreme Court Tuesday.
“SUPREME COURT UPHOLDS TRUMP TRAVEL BAN. Wow!” President Donald Trump exclaimed via Twitter Tuesday morning as news got out that the U.S. Supreme Court voted 5-4 to uphold his Executive Order “travel ban” against persons from Iran, Yemen, Somalia, Syria, Libya, Venezuela and North Korea.
Under the Immigration and Nationality Act, foreign nationals seeking entry into the United States undergo a vetting process to ensure that they satisfy the numerous requirements for admission. The Act also vests the President with authority to restrict the entry of aliens when- ever he finds that their entry “would be detrimental to the interests of the United States.”
Shortly after taking office, President Trump signed a series of orders, Protecting the Nation From Foreign Terrorist Entry Into the United States. Eventually, he was sued by the state of Hawaii, individuals (Dr. Ismail Elshikh, John Doe #1, and John Doe #2), and the Muslim Association of Hawaii. A District Court granted a nationwide preliminary injunction barring enforcement of the entry restrictions. The Court of Appeals affirmed. The case reached the Supreme Court – but on a 5-4 vote, sided with the President.
Attorney General Jeff Sessions responded to the Supreme Court Decision in Favor of the Trump Administration in Trump v. Hawaii, saying, “Today is a great victory for the safety and security of all Americans. The Constitution and Acts of Congress confer on the President broad discretion to protect the interests of the United States. Today’s decision is critical to ensuring the continued authority of President Trump – and all future presidents – to protect the American people. We will continue to take and defend all lawful steps necessary to protect this great nation.”
The Department of Homeland Security released the a statement regarding the Supreme Court’s decision, saying, “It is the duty of the government to ensure that those seeking to enter our country will not harm the American people. While we have the most generous immigration system in the world, it has repeatedly been exploited by terrorists and other malicious actors who seek to do us harm. President Trump’s executive actions take important steps to protect the American people by allowing for the proper review and establishment of standards to prevent terrorist or criminal infiltration by foreign nationals. Today’s ruling confirms the legality of these critically important executive actions, and the Department of Homeland Security will continue to faithfully execute our country’s immigration laws and treat everyone we encounter humanely and with professionalism.”
On the other side of the coin, The ACLU also respond to the Supreme Court decision, saying, “It’s a dark day in American history. The Supreme Court just allowed the Muslim ban to continue. In a 5-4 ruling, justices sided with this cornerstone of Trump’s discriminatory immigration policy. The latest version of the ban limits entry to the United States from citizens of five Muslim-majority countries in addition to a miniscule number of North Koreans and Venezuelans. Let’s be clear: This is a loss. But this isn’t the end of the fight – we’re committed to taking down this discriminatory ban on every front – in Congress, in the courts, and on the streets.”
