Mason City man jailed and fined for inhaling toxic vapors

MASON CITY – A Mason City man served jail time and was ordered to pay fines after a series of bizarre behaviors after he inhaled toxic vapors, a violation of city code.

James Garvin Mitchell, age 31 of Mason City, was arrested three times for violating city code that bans the inhalation of toxic vapors.

Mitchell was first arrested on September 14, 2016, in Central Park. Police allege he had been “witnessed huffing in the park.”

Mitchell was arrested a few days later on September 20 after being reported lying on ground, allegedly disoriented, in the Mills Fleet Farm parking lot with can of compressed air.

Finally, Mitchell was arrested in the 000 block of North Monroe Avenue on Thursday, September 29 at around 11:01 AM.

“Mitchell was allegedly acting strange, yelling at the air, and the caller(s) thought he should be checked on,” a police spokesman detailed. Officers found Mitchell in some trees nearby with a canister of compressed air that appeared to have recently been used.

As a result of his three arrests for this violation of city code, Mitchell was sent to jail for a total of 2 days and ordered to pay $382.50 in fines and court costs.

8-3-16: INHALATION OF TOXIC VAPORS PROHIBITED:

No person shall knowingly smell or inhale the fumes of toxic vapors for the purpose of causing a condition of euphoria, excitement, exhilaration, stupefaction, or dulled senses of the nervous system, or possess, buy, or use any such substance for the purpose of violating or aiding another to violate this section. But this section does not apply to the inhalation of anesthesia for medical or dental purposes.

As used in this section the term “toxic vapors” means the following substances or products containing such substances: acetone, alcohols (methyl, isopropyl, propyl, or butyl), aliphatic acetates (ethyl, methyl, propyl, or methyl cellosolve acetate), allyl isothiocyanate, benzene, butane, carbon tetrachloride, cyclohexane, ether, freons (freon 11 and freon 12), hexane, methyl ethyl ketone, methyl isobutyl ketone, methylene chloride, naphtha, nitrous oxide, perchlorethylene, propane, toluene, trichloromethane, trichloroethylene, or xylene, or other chemical substance capable of causing similar effects upon the human body. Evidence that a container, or a similar container, if the label is missing, lists one or more of these substances is prima facie evidence that the substance in such container contains toxic vapors and emits the fumes thereof. 75,000 dollars to remodel some of his private property and gave the church 85,000 dollars for stained glass windows – Now Manly needs a new snow plow and you only want to give a 28,000 dollar grant on a plow that costs $162,000 – What – which is more important ? No common sense answer is expected.

Low income home moderization federal grant (no doubt matching) sounds like their really going to help update some private owned low income homes here in Manly But it really looks like the city council wants the government (taxpayers) to build 143 single family dwellings in Manly and have welfare/refugees move in – no action on 3 votes finally Heagel and Ryan agreed to pass it. If this is for refugees or immigrants it is not for our good as Chicago and Detroit refugees are not a betterment to our town and the taxpayers of worth county will be responsible for the property taxes and etc. Thank you Mr. Wentz (government) and take your project elsewhere.

The article doesn’t say anything about him getting treatment. So instead of putting him in jail, he should have his head examined. What’s next for him.

why should the taxpayer have to pay for his “treatment”?
This is no accident, he chose and did it to himself. I am tired of paying for everybody elses bad choices. Deal with it

We pay to rehabilitate the thieves and drug users every day so they can go out and do it again. When do we say enough is enough?

We probably say it every day, but it doesn’t really matter, because we don’t have a choice.

Sometimes I have compassion for losers. Since your tired of paying for everybody else’s bad choices, you must be sleeping about now, have you looked at all the losers in jail, who do you think pays for their room and board. How you dealing with that???

I agree allen. You either choose long term solutions to problems, or accept dealing with the same problems over and over because of these short term fixes. The only thing prison benefits are the companies using them to make cheap products. Expecting people to get out and not go back to what they were doing is insane. Prison will technically make them worse, you are locked up around other people that will feed into your poor choices. That doesnt seem very affective. Proper therapy, and help dealing with addictions or mental health issues is a much more beneficial choice if we are looking for long term solutions. It just doesnt seem like we are putting money into places that are needed for a structurly sound society. Our schools are not doing well, and the mental health centers are being closed down. I have ran into far too many college age adults who are unable to count proper change. My dad tutors highschool kids, and ive looked through some of their school books, and everything has seemed to be over complicated for some reason? Simple math problems drawn out when its not needed.

He has already been offered. You can’t make someone accept help for an addiction. Alternative sentencing is always an option, but you have to request and follow through with treatment and classes. It’s much easier to just accept a few days in jail.

Your right, it’s all about personnel choices, of which we all have. And, there was no indication in the article that he had been offered help, thanks for the info.

If anyone could see what this does to people, I think they would never try it. So sad, too many local deaths from this stuff in the last few years.
