    The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on May 4, 2021. Due to COVID-19, the meeting was held as a virtual meeting via Zoom. The meeting was called to order by the Mayor and on roll being called there were present, Bill Schickel, Mayor in the Chair, and the following Council Members: Thoma, Jaszewski, Symonds, Lee, Adams, Masson. Absent: None.

    Adopt Agenda: Motion, Jaszewski; 2nd, Lee that the agenda be adopted. AYES: All (Motion carried.)

    The Mayor proclaimed May, 2021 as “Historic Preservation Month”.

    Prior to adopting the Consent Agenda Item #7, #8 and #14 were removed to be acted upon separately.

    8. Award Contracts WHKS – River City Renaissance Projects: Motion, Adams; 2nd, Jaszewski that Resolution No. 21-112, award contract for professional services to WHKS & Co. relating to River City Renaissance Site Improvements (design engineering services for lighting), 21-113 award contract for professional services to WHKS & Co. relating to the construction phase services for a site to be developed as a hotel as part of the River City Renaissance Project and 21-114, award contract for professional services to WHKS & Co. relating to the construction phase services for a skywalk over S. Delaware Avenue (US 65) – River City Renaissance Skywalk, be adopted. An overview was provided. AYES: All (Motion carried.)

    14. Order Hearing & Letting – “24th Street SW Paving Project”: Motion, Adams; 2nd, Symonds that Resolution No. 21-115, authorizing notice to bidders, fixing amount of bid security, and ordering Clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs for construction of the “24th Street SW Paving Project”, be adopted. Discussion followed regarding how common it was for a paving project to be privately financed, the City’s share of the project and whether road use tax was being used. AYES: All (Motion carried.)

    Order Public Hearing on Amendment #5 to Mason City Downtown: Administrator Burnett and David Rachie provided a presentation on the potential ownership of the mall and the repurposing of it into a family entertainment center. Motion, Lee; 2nd, Masson that Resolution No. 21-116, setting dates of a consultation and a public hearing on a proposed Amendment No. 5 to the Mason City Downtown Reinvestment Urban Renewal Plan in the City of Mason City, Iowa be adopted. Comments followed regarding the theatre, the timing/schedule of the project, the name change of the mall, etc. AYES: All (Motion carried.)

    Adjourn: The Mayor adjourned the meeting at 7:46 p.m.

    REVISED NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING ON PROPOSED PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF “WINNEBAGO RIVER LOW HEAD DAM MITIGATION – WINNEBAGO DAM NO. 1”, IN AND FOR THE CITY OF MASON CITY, IOWA, AND THE TAKING OF BIDS FOR SAID IMPROVEMENTS
    Sealed proposals, subject to the conditions contained herein, will be received by the City Clerk of the City of Mason City, Iowa, at the City Clerk’s office in City Hall at Mason City, Iowa, until 10:00 o’clock a.m. on the 26th day of May, 2021 for:
    Construction of “Winnebago River Low Head Dam Mitigation – Winnebago Dam No. 1”, as hereinafter described in general and as described in detail in the plans and specifications now on file in the office of the City Clerk, Mason City, Iowa.
    Proposals received will be opened, read aloud, tabulated, and referred to the City Council for consideration at 7:00 p.m. on the 1st day of June, 2021. Bids will be acted upon at such time or at such later time as may then be fixed. Prior thereto, at said time specified above, in the Mason City Room at the Mason City Public Library, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto.
    The extent of the work involved is the furnishing of labor and new materials for the construction of mitigation measures for the existing low head dam located on the Winnebago River south of 12th Street. The work will generally involve the construction of rock weirs and formations in the river, modifications to a storm sewer outfall, and related work.
    The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 5% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 5% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 5% of bid amount.
    The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.
    The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the Requirements of Iowa Code, Section 26.8.
    Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.

    Bidders shall not be permitted to withdraw their bids for a period of thirty (30) days after the same are opened.
    By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa and to Iowa domestic labor.
    In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.
    Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.
    Pursuant to City Ordinance No. 94-3, legally known as Title I, Chapter 10, of the Municipal code, general bidders shall include Form DBE 1. Prospective bidders’ or contractors’ attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractors’ attention is also directed to the fact that the Mason City Human Rights Commission may notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties. Determination of certification of compliance with these specifications shall be conducted by the Mason City Human Rights Director, following receipt of bids from prospective bidders or contractors.
    The established DBE goal for this project is 0% of the total project amount. The goals are subject to waiver by the commission.
    The right is reserved, as the interest of the City may require, to reject all bids, any unresponsive bid and to waive technicalities in bids received.
    The Contractor shall commence work after Notice to Proceed is issued and shall be completed on or before July 1st, 2022.
    Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the Owner.
    The Contractor will be paid each month ninety-five (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due

    until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.
    The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the Owner and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the Owner from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of one (1) year after completion and acceptance by the Owner.
    Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the Owner referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.
    Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and
    Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $100.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited.

    A middle school boy took a gun to school today (not in Iowa) and shoots teachers and other kids. Why do gun rights supporters defend people who shoot+ or kill people? There IS a difference between law-abiding gun owners and those who are irresponsible and not law-abiding! Accept that fact and help in the fight to prevent senseless shootings please. Keep the blinders on and one day it might be you or a family member who is shot or killed, none of us seem to be able to manage to weed out the irresponsibles due to their gun blindness.

    Cerro Gordo County Campgrounds opening

    Effective Friday May 7, 2021 at 12:00 pm, Cerro Gordo County will open Linn Grove Campground (Rockwell), Wilkinson Campground (Rock Falls) and Ingebretson Campground (Thornton) for the season with electric and restrooms. The campgrounds will remain open until late September with water and electric and mid-October with electric.     The method of construction shall be by contract. All work is to be done in strict compliance with plans and specifications prepared by the City Engineer of Mason City, Iowa, which have heretofore been approved by the City Council and are now on file for public examination in the office of the City Clerk.

    All work shall be done in accordance with the latest version of the City of Mason City Standard Specifications and the Iowa Department of Transportation, Standard Specifications for Highway and Bridge Construction.

    Each bid must be made out on a Proposal Form, furnished by the City and obtained at the office of the City Clerk.

    Each proposal shall be sealed in an envelope marked, “Proposal for the 2021 Sidewalk Program, Project No. 21-1005, Mason City, Iowa.” Each bid must be accompanied, in a separate envelope, by a bidding check or bid bond in an amount not less than ten percent (10%) of the bid price, said check being either a cashier’s check or a check certified by a bank in Iowa or a bank chartered under the laws of the United States, or a Certified Share Draft drawn on a credit union in Iowa or chartered under the laws of the United States, and made payable to the City Treasurer of the City of Mason City, Iowa, as a security that the bidder will furnish the required bonds and enter a contract within ten (10) days after the award of the contract.

    Payment for said “2021 Sidewalk Program” will be made with Road Use Tax Funds from the City of Mason City, Iowa, or from such other funds as may be legally used for such purposes. Monthly estimates will be made by the City Engineer, and payment will be made to the contractor in the amount of ninety-five percent (95%) of said estimate on or about ten (10) days thereafter. Payment shall not be made for materials stored off or on site. Final payment will be made not sooner than thirty (30) days following final acceptance of the work by the City of Mason City.

    Bidders shall not be permitted to withdraw their bids for a period of forty-five (45) days after the same are opened.

    By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa.

    Pursuant to Chapter 73 of the Code of Iowa, out-of-state bidders are hereby advised of the Iowa Bidding Preference Law extending to Iowa firms any preference out-of-state competitors receive in their own states. Such preference may be (a) strict preference, (b) reciprocal preference, or combination preference and reciprocal. Application of such preference will be extended for any “public improvement” as defined in Chapter 73A.1 of the Code of Iowa.

    Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.

    The bidders’ attention is called to the prompt payment to the subcontractors, under Chapter 573.12 of the Code of Iowa.

    The final completion date for the project is September 30, 2021.

    Plans and specifications governing the construction of the proposed improvements have been prepared by the City Engineer of Mason City, Iowa, which plans and specifications are hereby made a part of this notice and the proposed contract by reference, and the proposed contract shall be executed in compliance therewith.

    Copies of said plans and specifications are now on file in the office of the City Clerk, City Hall, 10 1st Street NW, Mason City, Iowa, for examination by bidders. A refundable deposit of $25 will be required for the Plans and Project Manual. To receive a refund both the Plans and Project Manual must be returned in complete and reusable condition within fourteen days of the award of the project.

The bid security shall be in the form of a cashier’s check or certified check drawn on a state-chartered or federally chartered bank, or a certified share draft drawn on a state-chartered or federally chartered credit union, or a bidder’s bond with corporate surety satisfactory to the City.     In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.

    Bidders shall be expected to comply with Chapters 91C and 103A of the Code of Iowa concerning the registration and bonding of construction contractors and the successful bidder shall be required to supply the City of Mason City with proof of said compliance.

    Payment to the contractor will be made in cash, the proceeds of bonds, notes or project notes, or from the payment of special assessments not pledged to the payment of Special Assessment Bonds, and in cash derived from the sale of Special Assessment Bonds, to be issued in accordance with Chapter 384 of the Code of Iowa, 2019, and in particular, Section 384.68 of said Code, in anticipation of the collection of said special assessments, an estimate of such assessments being on file with the City Clerk, said bonds to be sold by the City at not less than the par value thereof, plus accrued interest. Any deficiency between the amount of the contract price of said improvements and the amount of proceeds from the payment of unpledged special assessments and from the sale of said Special Assessment Bonds shall be paid from the proceeds of the issuance and sale of General Obligation Bonds, as may be legally issued and/or from such other funds as may be legally used for such purposes.

    Payment will be made to the contractor in the amount of one hundred percent (100%) of the contract value, following the thirty (30) day period from the City Council’s acceptance of work, subject to the conditions and in accordance with the provisions of Chapters 26 and 573 of the Code of Iowa, as needed. The contractor will be paid each month, ninety-five percent (95%) of the engineer’s estimate of the value of acceptable work completed at the end of the preceding month.

    The Proposal shall be made out on the form furnished by the City of Mason City and obtained from WHKS & Co., Engineers, Planners, and Surveyors, and must be accompanied in a sealed envelope by either: (1) a certified check, or a cashier’s check drawn on an Iowa bank, or a bank chartered under the laws of the United States, in an amount of 5% of bid amount; or (2) a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount of 5% of bid amount; or (3) a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the penal sum of 5% of bid amount.

    The bid security shall be made payable to the City Clerk of the City of Mason City, Iowa.

    The bid security must not contain any conditions either in body or as an endorsement thereon. The bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into contract within ten (10) days after the award of contract and post bond satisfactory to the City insuring the faithful fulfillment of the contract and the maintenance of said work, if required, pursuant to the provisions of this notice and the other contract documents. The City will accept bid bond forms that meet the Requirements of Iowa Code, Section 26.8.

    Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time of the contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption.

    Bidders shall not be permitted to withdraw their bids for a period of thirty (30) days after the same are opened.

    By virtue of statutory authority, a preference will be given to products and provisions grown and produced within the State of Iowa and to Iowa domestic labor.

    In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.

    Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor’s resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.

    Pursuant to City Ordinance No. 94-3, legally known as Title I, Chapter 10, of the Municipal code, general bidders shall include Form DBE 1. Prospective bidders’ or contractors’ attention is specifically called to the Mason City Human Rights Commission Specifications which mandates that female and minority business enterprises shall be afforded the maximum opportunity to participate in the performance of this project. Prospective bidders’ or contractors’ attention is also directed to the fact that the Mason City Human Rights Commission may notify firms designated as Minority, Women, and/or Disadvantaged Business Enterprises, of this project and determine if they are interested in participating as subcontractors for this project. Prospective bidders or contractors shall then be notified by the Commission of those interested parties. Determination of certification of compliance with these specifications shall be conducted by the Mason City Human Rights Director, following receipt of bids from prospective bidders or contractors.

    The established DBE goal for this project is 0% of the total project amount. The goals are subject to waiver by the commission.

    The right is reserved, as the interest of the City may require, to reject all bids, any unresponsive bid and to waive technicalities in bids received.

    The Contractor shall commence work after Notice to Proceed is issued and shall be completed on or before November 26th, 2021.

    Payment to the Contractor for said Project will be made in cash derived from the proceeds of the issuance of bonds as may be legally used for such purposes, governmental grants and/or from cash on hand. Any combination of the above methods of payment may be used at the discretion of the Owner.

    The Contractor will be paid each month ninetyfive (95) percent of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. Final payment will be made in accordance with Iowa Code chapters 26 and 573, as amended. No partial or final payment will be due until the Contractor has certified to the City that the materials, labor and services involved in each estimate have been paid for in accordance with the requirements stated in the specifications.

    The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent of the contract price, said bond to be issued by a responsible surety approved by the Owner and which shall guarantee a faithful performance of the Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the Owner from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of the improvements constructed for a period of one (1) year after completion and acceptance by the Owner.

    Plans and specifications governing the construction of the proposed improvements have been prepared by WHKS & Co., Engineers, Planners, and Surveyors, which plans and specifications and the proceedings of the Owner referring to and defining said proposed improvements are hereby made a part of the Notice by reference, and the proposed contract shall be executed in compliance therewith. Copies of said plans and specifications are now on file with the City Clerk and at the offices of WHKS & Co., and may be examined by the bidders.

    Plans and specifications are available to download free of charge at http://www.questcdn.com. Plans and specifications for private use may also be obtained from WHKS & Co., Engineers, Planners, and Surveyors, 1412 6th Street SW, Mason City, IA 50402-1467, for a refundable deposit of $100.00. If the plans and specifications are not returned to WHKS & Co. within fourteen (14) days after the award of the project and in reusable condition, the deposit shall be forfeited.

    The Charles City Water Department will begin flushing the City’s water distribution system on May 3rd, 2021 and will finish by May 28th.

    Annual flushing of the hydrants is necessary to remove any deposits that may build up on the interior walls of the underground water mains. This process is necessary to ensure that water quality is maintained throughout the system. Customers may experience fluctuations in pressure and/or discoloration of their water during flushing.

    It also allows the Water Department to operate all fire hydrants in the distribution system and identify any maintenance requirements for each fire hydrant on an individual basis.

    If you experience discolored water, run your cold water tap until it clears. During periods of discoloration, postpone washing clothes and limit your use of hot water. Any issues will be resolved in a short time.
