Mason City man avoids second offense drunk driving charge in plea deal

MASON CITY – A man who cops said drove drunk as he left a North End bar and then refused to pull over for police has taken a plea deal and avoided a second offense drunk driving charge.

Nathaniel Wetter, age 41, was arrested for operating while intoxicated, failure to yield to emergency vehicle, and interference with official acts after an incident on August 26, 2014 where he left a Mason City bar and refused to stop as police tried to pull over his van. His passenger, 39-year-old Timothy Despenas, was arrested for fifth degree criminal mischief, disorderly conduct, and public intoxication.

Witnesses reported to police that Despenas had thrown a pool ball and also threw a glass mug at a door causing damage when he became disorderly at the bar. The damage was estimated to be under $200.00. Despenas and Wetter then left in a van as officers were arriving. Witnesses pointed to the van as it was starting to drive away from the parking lot on North Federal Avenue. Officers attempted to stop the van, but Wetter took off. Officers pursued, and the van failed to pull over for the police car attempting to stop it with flashing lights and sirens and continued driving for a few blocks before it finally stopped in the 1400 block of North President.

Wetter – a convicted felon out of Story county for possession of dangerous weapons – pleaded guilty to eluding on December 17. He was ordered to pay $4,000 in fines and court fees and sent to jail for seven days. He already paid $2,000, records show. Wetter also entered a guilty plea to interference with official acts but awaits sentencing. The charge of failure to yield to an emergency vehicle was dismissed.

Despenas later pleaded guilty to fifth degree criminal mischief while eh other charges were dismissed. He was ordered to pay $455.00, which included $5.00 in restitution.
