MINUTES
REGULAR MEETING
OF THE CITY COUNCIL

The City Council of the City of Mason City, Iowa, met in regular session pursuant to law and rules of said Council, in the Mason City Room of the Mason City Public Library, at 7:00 P.M., on January 7, 2014. The meeting was called to order by the Mayor and on roll being called there were present, Eric Bookmeyer, Mayor in the Chair, and the following Council Members: Kuhn, Hickey, Tornquist, Marinos, Lee. Absent: Solberg.

The Mayor provided the following state of the City report:

Adopt Agenda: Motion, Kuhn; 2nd, Marinos that the agenda be adopted. AYES: All (Motion carried.)

The Mayor proclaimed January 24, 2014 as “Coaches vs. Cancer Day.”

Prior to adopting the Consent Agenda Item #14 was removed to be acted upon separately.

Consent Agenda: Regular, Closed and Special Minutes of December 17, 2013, Worksession and Special Minutes of December 19, 2013; Claims dated December 19 and 26, 2013 and January in the amount of 1,563,247.12; Acceptance of the Priority and Operations Review Report; Acceptance of the Ward 1 Listening Post; Approval of City Council Goals and Priorities; Approve the current location of the 2013 Peoples Choice Award Sculpture, at the corner of 2nd Street SE and S. Connecticut Avenue; Resolution No. 14-1, levying assessments for charges on certain properties and the certification of same of the County Treasurer for collection with property taxes; Resolution No. 14-2, to permit the temporary closure of public ways for block parties and other temporary events in 2014; Resolution No. 14-3, approving the re-adoption of the Investment Policy for the City of Mason City, Iowa; Resolution No. 14-4, naming depositories for the City of Mason City, Iowa; Resolution No. 14-5, approving a change order and accepting work and ordering payment for construction of the “South Taft Avenue Pedestrian Bridge”, City of Mason City, Iowa; Resolution No. 14-6, approving the submission of an “Iowa Great Places” application in the City of Mason City, Iowa, was presented. Motion, Tornquist; 2nd, Kuhn that all remaining items in the Consent Agenda be approved and resolutions adopted. AYES: All (Motion carried.)

14. Preliminary Plat – Asbury Farms Ninth Subdivision: Motion, Hickey; 2nd, Marinos that Resolution No. 14-7, approving preliminary plat for “Asbury Farms Ninth Subdivision”, be adopted. Discussion followed regarding sidewalks. AYES: All (Motion carried.)

15. Changes to Ordinance – Sign Regulations: The public hearing was held as per published notice and the Mayor called for comments and objections. There being no comments, the public hearing was declared closed. Motion, Tornquist; 2nd, Kuhn that the ordinance amending the City Code by repealing Title 12, Chapter 20: Sign Regulations and adopting a new Chapter 20 in lieu thereof be received and placed on file for First Consideration. AYES: All (Motion carried.)

16. Amendments to Outdoor Dining: Motion, Tornquist; 2nd, Lee to waive 2nd Reading of the ordinance. Comments followed regarding waiving 2nd Reading. AYES: All (Motion carried.) Motion, Hickey; 2nd, Lee that Ordinance No. 14-1, amending the City Code by amending Title 12 “Zoning” Chapter 2 “Definitions” Section 2 “Definitions” to include an additional definition; repealing Chapter 8 “Zoning Districts – General” Section 2 “Zoning Form and Function Table (12-8-2)” and adopting a new table in lieu thereof; repealing Chapter 9 “Z1 Agricultural District” Section 7 “Forms and Functions: Table (12-9-1); amending Chapter 9 “Z1 Agricultural District” Section 8 “Development Standards” Table 12-9-2; repealing Chapter 10 “Z2 Sub-Urban District” Section 7 “Forms and Functions” Table (12-10-1); amending Chapter 10 “Z2 Sub-Urban District” Section 8 “Development Standards” Table 12-10-2; repealing Chapter 11 “Z3 General Urban District” Section 7 “Forms and Functions” Table (12-11-1); amending Chapter 11 “Z3 General Urban District” Section 8 “Development Standards” Table 12-11-2; repealing Chapter 12 “Z4 Multi-Use District” Section 7 “Forms and Functions” Table (12-12-1); amending Chapter 12 “Z4 Multi-Use District” Section 8 “Development Standards” Table 12-12-2; repealing Chapter 13 “Z5 Central Business District” Section 7 “Forms and Functions” Table (12-13-1); amending Chapter 13 “Z5 Central Business District” Section 8 “Development Standards” Table 12-13-2; repealing Chapter 14 “Z6 Industrial District” Section 9 “Forms and Functions” Table (12-14-1); amending Chapter 14 “Z6 Industrial District” Section 10 “Development Standards” Table 12-14-2; repealing Chapter 15 “Z7 Specific Use District” Section 4 “Forms and Functions” Table (12-15-1) ; amending Chapter 15 “Z7 Specific Use District” Section 5 “Development Standards” Table 12-15-2; amending Section 16 “Zoning Standards” to add and additional Chapter 19 “Outdoor Customer Dining”, be adopted. AYES: All (Motion carried.)

17. Amendments to Building Sign Code: Motion, Lee; 2nd, Kuhn that the ordinance amending the City Code, by repealing Title 10, Chapter 2: Building Codes, Article G. Sign Code in its entirety and adopting a new Article G in lieu thereof, be received and placed on file for first consideration. AYES: All (Motion carried.)

18. Council Rules: Motion, Lee; 2nd Kuhn that the Resolution be adopted. Motion, Lee; 2nd, Kuhn to amend the motion so that Item #10 of the Resolution read “The City Council will conduct a “Citizens Comment” section which will provide citizens an opportunity to speak, up to five minutes, on any topic they want to address. If a repose is deemed befitting, the Mayor or his designee may comment in order to offer further assistance to the citizen on the issue.” Discussion followed. Question called on the amendment: AYES: Lee, Kuhn, Tornquist. NAYS: Hickey, Marinos (Motion carried.) Motion, Kuhn; 2nd, Marinos to extend debate: AYES: All (Motion carried.) Question called on the Resolution as amended: AYES: Lee, Kuhn, Tornquist. NAYS: Hickey, Marinos (Motion failed.) Motion, Hickey; 2nd, Marinos that the Resolution be adopted as presented in the packet. Motion, Kuhn; 2nd, Lee to amend to motion to read “The City Council will conduct a “Citizen Comments” that will allow citizens the opportunity to speak on a topic they want to address. The Mayor will respond or recognize the City Administrator or a City Council Member to respond to the speaker as needed.” Discussion followed. Question called on the amendment: AYES: Kuhn, Lee, Tornquist. NAYS: Hickey, Marinos (Motion carried.) Question called on the Resolution as amended. AYES: Lee, Kuhn, Tornquist. NAYS: Hickey, Marinos (Motion failed.) Motion, Hickey; 2nd, Marinos that Resolution No. 14-8 (as presented in the packet) rescinding Resolution No. 06-186 in its entirety and adopting a new resolution in lieu thereof amending the rules of procedure for council meetings, with additions to the general policy statements for the City of Mason City, Iowa, be adopted. AYES: Kuhn, Tornquist, Marinos, Hickey. NAY: Lee (Motion carried.)

Adjourn: The Mayor adjourned the meeting at 8:50 p.m.
