Muscatine, IOWA — On July 25, 2013, 46 year old Thomas Andrew Tovar, was arrested and charged with Sexual Assault, Third Degree (Class C Felony) under Iowa state code section 709.4(3)(b). Tovar is currently being held in the Louisa County Jail.
On February 13, 2013, Thomas Tovar, a police officer with the Muscatine Police Department, assisted with a vehicle stop. The passenger of the vehicle was an adult female. This female was intoxicated and was given transportation to her hotel by Tovar. Due to her level of intoxication, the adult female recalls the OWI stop but has very little recall on how she was transported from the vehicle stop to the hotel. She does remember a male being on top of her while lying on the bed in the hotel room. The male was wearing clothing with uniform-like material and was lying over the top of her and consoling her. Later in the morning, a friend arrived at the hotel to find her lying on the bed in a fetal position with no clothes on. That same morning, the Muscatine Police Department received a complaint from the adult female.
Subsequently, the Muscatine Police Department and the Muscatine County Attorney’s Office requested the Iowa Division of Criminal Investigation begin an investigation into the incident. After conducting a number of interviews, and an analysis of physical evidence to include DNA, probable cause was found to charge Tovar with the sexual assault.
Tovar has since resigned from the Muscatine Police Department.
