Mason City burglar gets another plea bargain and probation

MASON CITY – For a second time in four months a Mason City man has received a plea bargain in felony charges.

Drake Andrew Shimon, age 21, received a plea bargain on November 8th, 2012 amending what was originally a Class D felony count of 2nd Degree Criminal Mischief down to a simple misdemeanor count of 5th Degree Criminal Mischief. The charges came after Shimon and 3 other co-defendants caused over $1,000 dollars in damage while paint balling a victim’s home from a vehicle. Over 20 other cars were vandalized that night, but Shimon and his co-defendants were never tied to those vandalisms.

Shimon has agreed to pay restitution to the victim that was able to tie him to the crime court records show his efforts have been to pay $15 dollars thus far.

A month after the previous plea bargain a Mason City police officer located an open door to a storage unit at 1621 12th Street NE on December 3rd. Police notified the owner and took an inventory of property stolen which included a Yamaha dirt bike. Mason City police were able to identify four individuals involved in the burglary and recover the Yamaha dirt bike.

Arrested for the burglary to storage units and vehicles were Drake Andrew Shimon, Wraymond Leon Todd, Braedon Steven Bowers, and Tyler Lee Donahoo.

Braeden Bowers, age 15, has been adjudicated on A 3rd Degree Burglary charge and placed in a juvenile detention setting.

Wraymond Todd and Tyler Donahoo both have pled not guilty and have a joint trial set for April 30th in Cerro Gordo County District Court.

Drake Shimon reached another plea agreement with the prosecution in exchange for a plea of guilty to one Class D felony count of 3rd Degree Burglary, the prosecution would not pursue a Class D felony count of Conspiracy to Commit a Felony.

At Shimon’s sentencing hearing on Monday, March 4th, presiding District Court Judge Colleen D. Weiland approved the plea bargain and dismissed the felony count of Conspiracy to Commit a Felony. Judge Weiland gave Shimon a suspended 5 year prison sentence, and suspended the minimum $750 dollar fine for the 3rd Degree Burglary. Shimon was ordered to serve 2 years of probation with the Iowa Department of Corrections and repay $826.00 in restitution to the victims. The online records do not show a time frame for the restitution to be repaid.
