DES MOINES – A bill approved by the Senate Agriculture Committee would make fuel pumps more accessible to Iowans with disabilities, according to Iowa Senate Democrats.

If SF 235 is passed, gas stations in Iowa will have to comply with standards established by the federal Americans with Disabilities Act (ADA).

The bill would also require gas stations that are staffed with more than one employee on duty to provide refueling assistance upon request by a person with disabilities. The department of agriculture and land stewardship would have to establish standards by rule requiring a retail dealer to have a motor fuel pump capable of assisting persons with disabilities, including the federal Americans with Disabilities Act and state requirements for a sign to be posted on or near the motor fuel pump which allows a customer to receive personal assistance from a retail dealer by using a special call button.

By January 1, 2014, gas stations must have at least one ADA-compliant motor fuel pump with signs stating the hours refueling assistance is available.

A retail dealer who violates a provision of the bill is guilty of a simple misdemeanor. Each day that a continuing violation occurs shall be considered a separate offense.

One lobbyist so far opposes the legislation, David Scott, of the American Petroleum Institute. Lobbyists for Hy-Vee, Kum and Go and Casey’s are all undecided.
