MASON CITY – Two Minnesota men were arrested and charged with burglary and other offenses after an incident at a Mason City apartment on December 4th.
Mason City police were called to 149 19 Street SW at 2:53 PM for a violation of a no contact order and arrested the two adult male subjects.
Arrested were Riki Joseph Whelan, 24, and Mitchell Magavin Stevens, 26, both showing addresses in Gordonsville, Minnesota. Both men were taken to the Cerro Gordo County Jail and booked and remained there as of Saturday.
Whelan was charged with burglary in the third degree, a class D felony.
Stevens was charged with burglary in the third degree (a class D felony), enhanced domestic assault, and violation of a no contact order (criminal).
The domestic assault charge is Stevens’ third or subsequent charge. On November 27th, 2012, Stevens made a plea deal and plead guilty in Winnebago County Court to domestic assault while displaying a weapon. Judge Dedra Schroeder accepted a diminished charge; Stevens was originally charged with domestic assault third or subsequent offense, a class D felony. She handed down suspended prison time and a suspended fine and probation.
In addition, Stevens was charged by the Iowa State Patrol with possession of drug paraphernalia on December 5th, 2012.
Stevens was also charged in Cerro Gordo county on November 13th, 2012 with violating no-contact order.
Stevens is being held on $10,000 cash bond. Whelan is being held on $5,000 cash bond.
